As bad as the conspicuous "appearance of impropriety" was Alito's attempted disassociation from all the flag flapping fuss. His excessively effusive excuse was less than credible. However, his cantankerous protest did manage to paint his wife as a possible "person of interest" in the leak of Dobbs draft opinion.
Very well stated. In SD at least we maintain a judicial code that provides that there is a conflict of interest for a judge when there is the "appearance of impropriety". Unfortunately, our judicial code does not govern Justice Alito's rather weak justification for non-recusal.
Explain across the board, please, what you mean by impartiality and avoidance of conduct that inspires concerns about the “appearance” of partisanship. Which of the justices currently on the SCOTUS do you hold up as the example of ethical purity and impartiality you want the others to follow? The one who didn't recuse herself from a suit that involved a publisher that was paying her? The one who blurted out loud the completely ignorant false statement that 100,000 U.S. children were in serious condition with COVID-19, with many on ventilators? The one who prior to confirmation was unwilling to say the common meaning of a common word?
An upside down flag is an indicator that the country is in distress. That's not political. That's factual, no matter which side of the matter you support. Unless you live in DC, in which case all things are copacetic as long as the favorite restaurants stay open. An Appeal to Heaven flag is only troubling to those who are offended by the idea of appealing to Heaven.
The chronic smear campaign of Democrats and their mouthpieces against Justices who aren't in lockstep with them is really tiresome. Senator Joe Biden tried that high tech lynching against Clarence Thomas during his confirmation hearings. Brett Kavanaugh and his family were subjected to the most dishonest garbage imaginable by the Democrats and their press. Amy Coney Barrett was smeared for being a Catholic and adopting children who didn't look like her. Chuck Schumer stood on the steps of the Supreme Court and openly threatened the Justices if they didn't decide things his way. And the Biden administration's DOJ refused to enforce the law that is supposed to protect judges from rioters gathering at their private homes.
Democrat mouthpieces rely on the courtesy and honor of conservative people in order to try to shame them into silence and inaction. It's a brilliant tactic, because it's one that does not work in reverse. It doesn't work on people who have no shame. We'll see how long that continues to work for y'all.
So why do we care about this author's small non-profit in Idaho with a mission statement for "gender equity" in a SD paper? Most of South Dakotans do believe the election was stolen and that is a reason for national distress. Most intelligent people know tht J6 was a witch-hunt and a travesty of justice...yet we are supposed to believe that people don't trust the courts because of Alito? Seriously, that is the most ridiculous proposition I have heard. Maybe we don't trust the courts because God-fearing people are trampled on while thieves, traffickers and murderers get pardoned by the courts. But no...lets blame Alito for a flag in his front yard...even though 99% of America never even heard of his up-side-down flag. Where do you even find these yahoos for "commenting" in a SD paper?

I could hardly disagree more, sister.
A perfectly complete and compelling analysis of the situation. Thank you.
