PUBLIC NOTICE
Notice is hereby given that all owners or persons in possession of property abutting on sidewalks to keep the sidewalks free from snow and ice and to remove the same within 48 hours after every fall or accumulation of snow or ice according to the following standards as set forth by Chapter 96 of the Code of Ordinances of Sioux Falls, SD:
§ 96.100 DUTY TO REMOVE SNOW.
(a) The owner or person in possession of any property abutting on any sidewalk shall keep the sidewalk free from snow and ice and shall remove any snow or ice from the sidewalk within 48 hours after the termination of any snow fall, snow or ice accumulation.
(b) The owner or person in possession of any property abutting upon any sidewalk which ends at an intersection or crosswalk shall maintain the sidewalk free from snow and ice to the edge of the street. Snow and ice deposited on the sidewalk in the street removal process shall be removed within 48 hours of being deposited.
If the owner or person in possession of property abutting on sidewalks fails to remove the snow or ice within 72 hours of the falling or accumulation hereof, the City will cause the snow or ice to be removed with an independent snow removal service and charge the cost to the abutting property.
If the bill is left unpaid, the cost will be assessed against that property to include the cost of levying such special assessment. In addition, the City’s Code Enforcement Officer will issue administrative citations in the amount of $100 for the first violation. Subsequent violations will cost more.

Section 1. That Section 131.001 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 131.001 DISORDERLY CONDUCT.
A person commits disorderly conduct when he or she knowingly:
(a) Creates a disturbance of the public order by an act of violence or by an act likely to produce violence;
(b) Engages in, promotes, instigates, encourages, aids or abets fighting or any similar violent threatening or tumultuous behavior;
(c) Makes or causes any unreasonably loud noise;
(d) Addresses profane, obscene or abusive language or threats of violence to any person present so as to create a clear and present danger of violence;
(e) Refuses or fails to cease and desist any peaceful conduct or activity likely to produce a breach of peace where there is an imminent threat of violence and where the police have made all reasonable efforts to protect the otherwise peaceful conduct and activity and have requested that the conduct and activity be stopped and explained the request if there is time;
(f) Fails to obey a lawful order of dispersal by a person known by him or her to be a peace officer under circumstances where three or more persons are committing acts of disorderly conduct in the immediate vicinity which acts are likely to cause substantial harm or serious inconvenience, annoyance or alarm;
(g) Unreasonably obstructs or interferes with pedestrian or vehicular traffic or use thereof or so as to create an unsafe condition for vehicular or pedestrian traffic or use of the street or sidewalk;
(h) Damages, befouls or disturbs public property or private property of another so as to create an unsafe, unhealthy or unsanitary condition; or
(i) Carries in a threatening or menacing manner, without authority of law, any pistol, revolver, dagger, razor, dangerous knife, stiletto, knuckles, slingshot, an object containing noxious or deleterious liquid, gas or substance or other dangerous weapon.

Transportation Alternative Program Grant
Mayor Deborah McIsaac presented the council with the application for the Transportation Alternative Program Grant as well as letters of Support from the council to send to Sophie Johnson with SECOG. Brian McGreevy made a motion to approve finance officer, Lacey Harrington, to use the Mayor’s stamp to approve Resolution 2024-3 to allow SECOG to submit the application for the Transportation Alternative Program Grant, Sinding seconded. All ayes, motion passed.
NEW BUSINESS
Mayor McIsaac and Finance Officer Harrington presented the council with a request from the Baltic Lutheran Church to close the street for their annual Trunk-or-Treat event on October 27, 2024 from 1 pm to 4 pm from 3rd St. to 4th St. Brian McGreevy made a motion to approve a street closure from 1 pm to 4 pm from 3rd to 4th St., Sinding seconded, all ayes, motion passes.
Alderman McGreevy reminded the council and residents of the importance of submitting the lead pipe survey to the City of Baltic or completing it online. It was agreed that the City will send out text reminders twice a week until the deadline has passed.

Chairman Wilson presented the committee with a variance request from Brian McGreevy for 99 Morefield. He is requesting 10 ft setback to the railroad instead of the 20 ft requirement. The front and sides would be the same, the only change would just be against the railroad. Ryan Fods and Ed Wilson agreed that the land would never change so they do not see a problem with it. The committee discussed the drawing provided and measurements presented. Sinding made a motion to approve the variance, seconded by Debbie Murphy, all ayes, motion carried.

This project may be partially funded using American Rescue Plan Act (ARPA) funds. As a condition of the ARPA funding guidelines, the Contractor shall meet the following minimum requirements:

Based on the “Build America, Buy America” provisions of the Infrastructure Investment and Jobs Act (IIJA) and E.O. 14005 which provide that, as appropriate and to the extent consistent with law, a preference will be provided to Contractors for the purchase, acquisition, or use of goods, products, or materials produced in the United States (including but not limited to iron, aluminum, steel, cement, and other manufactured products). The Contractor shall provide documentation of their efforts to meet the provisions of “Build America, Buy America” upon request.
2. The Contractor shall make a good faith effort to utilize Disadvantaged Business Enterprises (DBE) and/or Minority Business Enterprises (MBE) and shall provide documentation of the effort to solicit bids from qualified entities upon request. A copy of the DBE Subcontractor Solicitation Information Form shall be included with the original bid submission documents.
