The City of Sioux Falls has adopted a Disadvantaged Business Enterprise Plan. This Plan expresses the commitment of the City of Sioux Falls that disadvantaged business enterprises have the maximum opportunity to compete for and perform federally assisted contracts and subcontracts.
The City of Sioux Falls has available the latest Disadvantaged Business Enterprise directory in the Engineering office to facilitate identifying those certified disadvantaged business enterprises within the state of South Dakota.
Bidders for this work will be required to comply with the President’s Executive Order Nos. 11246 as amended, 11518 and 11625 as amended. The requirements for bidders and contractors under these orders are explained in the specifications.
Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order 12138. The requirements for bidders and contractors under this regulation which concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Women’s Business Enterprises (WBE) are explained in the specifications. The DBE/MBE and WBE goals for participation in this contract in terms of percentage of contract value are as follows: MBE 1.0 percent; WBE 4.0 percent.
Only firms certified at the time of the letting and included on the DBE Directory at dot.sd.gov, will count toward DBE participation.
Federal financial assistance will be used to fund all or a portion of the contract. The contractor will comply with all applicable Federal laws, regulations, executive orders, Federal policies, procedures, and directives including, but not limited to 2 CFR §§200.318-200.327.
Davis Bacon and Related Acts wages apply to this project. All provisions relative to those Acts must be met.
All bidders must be registered in the System for Award Management (SAM.gov), provide their Unique Entity Id (UEI), and have an active status.
To be considered a responsive bidder, the bidder must certify to compliance with the American Iron and Steel provision of the Consolidated Appropriations Act of 2014. This certification form may be found on page AIS-21 of the State Revolving Fund (SRF) General Conditions and must be included in the bid proposal.
Please be advised that waivers or exemptions from the American Iron and Steel provision that cite International Trade Agreements DO NOT comply with the Consolidated Appropriations Act of 2014 as it applies to the SRF programs. Claims from suppliers that the American Iron and Steel provision do not apply to certain products based on the International Trade Agreement exemptions of the Consolidated Appropriations Act of 2014 will not be accepted.
The low responsive bidder must assure compliance with the requirements of Public Law 115-232, Section 889, Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment. Contractors must assure that telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities), and video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities) WILL NOT be supplied for the project.
Your special attention is invited to the attached Bidders Activity Report (BAR), Forms A and B, and Debar-2 form. The BAR form must be completed and submitted with your bid proposal, along with either Form A or Form B, and Debar-2 form. Failure to submit the Form BAR, appropriate form A or B, and Debar-2 form will cause the bid to be rejected. Completion of the Bidders Activity Report is necessary in order to fulfill the requirements of obtaining a complete list of contractors contacted with regard to this project, in accordance with 49 CFR 26.11c. Statistical information used from the Bidders Activity Report will be used in the calculation of the next year’s DBE goals. By completing Form A, you are advising the City how the contract goal will be met. In the event you believe you will be unable to meet the goals, the attached Form B must be completed and submitted with the Bid Proposal. Please be advised that good-faith efforts will be subjected to close scrutiny and if the good-faith effort submission is unacceptable, your bid will be rejected.

WHEREAS, the City of Sioux Falls (the “City”) is authorized by Chapter 10-52 of the South Dakota Codified Laws (the “Act”) to levy a non-ad valorem tax (as defined by the Act) on the sale, use, storage, and consumption of certain items taxed under Chapters 10-45 and 10-46 of the South Dakota Codified Laws, subject to certain exceptions, at a rate not to exceed 2 percent;
WHEREAS, the City has adopted and enacted Ordinance No. 78-87, codified as Sections 37.001 and 37.020 of the Code of Ordinances of Sioux Falls, SD, imposing a sales and use tax authorized by the Act with the City at the rate of 1 percent, and Ordinance Nos. 70-03, 14-04, 26-06, and 116-08, codified as Sections 37.002 and 37.021 of the Code of Ordinances of Sioux Falls, SD (the “Second Penny Tax Ordinance”), imposing an additional sales and use tax authorized by the Act with the City at the rate of 1 percent effective January 1, 2009 (the tax imposed pursuant to the Second Penny Tax Ordinance being referred to herein as the “Second Penny Tax”);
WHEREAS, the City is authorized to issue sales tax revenue bonds in anticipation of the collection of sales and use taxes pursuant to Section 10-52-2.10 and Chapter 6-8B of the South Dakota Codified Laws and to pledge the revenues from such taxes to the payment of such bonds;
WHEREAS, pursuant to the Second Penny Tax Ordinance, the City is authorized to expend revenues from the Second Penny Tax for certain designated improvements, including the Projects (as defined hereinafter), and the retirement of debt incurred for such improvements;
WHEREAS, the City has previously issued its sales tax revenue bonds in various series under an indenture of trust (the “Original Indenture”), dated as of August 15, 1988, between the City and The First National Bank in Sioux Falls (the “Original Trustee” and together with any successors or assigns, the “Trustee”) as supplemented by a First Supplemental Indenture dated as of September 1, 1991, and a Second Supplemental Indenture dated as of December 1, 1991, and all of said bonds have been paid or defeased;
WHEREAS, under the provisions of the Original Indenture, the City is permitted, pursuant to a supplemental indenture, to issue additional sales tax revenue bonds on a parity with the outstanding bonds issued under the Original Indenture as supplemented from time to time if the conditions specified therein are satisfied;
WHEREAS, the City has previously issued its Sales Tax Revenue Notes under Loan Agreements dated as of May 24, 1990, and November 3, 1994, between the City and The First National Bank in Sioux Falls, and such Notes have been paid or defeased;
WHEREAS, the City has previously issued its Sales Tax Revenue Bonds, Series 1993 (the “Series 1993 Bonds”) pursuant to a Third Supplemental Indenture (the “Third Supplemental Indenture”) dated as of December 15, 1993, between the City and the Trustee and all of the Series 1993 Bonds have been paid or defeased;
WHEREAS, the City has previously entered into a Fourth Supplemental Indenture (the “Fourth Supplemental Indenture”) dated as of November 1, 1996, between the City and the Trustee, pursuant to which certain amendments have been made to the Third Supplemental Indenture with respect to the Construction Fund and the Debt Service Reserve Fund;
WHEREAS, the City has previously issued its Sales Tax Revenue Bonds, Series 1996A (the “Series 1996A Bonds”) and its Sales Tax Revenue Bonds, Series 1996B (the “Series 1996B Bonds”), pursuant to a Fifth Supplemental Indenture (the “Fifth Supplemental Indenture”) dated as of December 15, 1996, between the City and the Trustee and all of the Series 1996A Bonds and the Series 1996B Bonds have been paid or defeased;
WHEREAS, the City has previously issued its Sales Tax Revenue Bonds, Series 1999 (the “Series 1999 Bonds”), pursuant to a Sixth Supplemental Indenture (the “Sixth Supplemental Indenture”) dated as of September 1, 1999, between the City and the Trustee and all of the Series 1999 Bonds have been paid or defeased;
WHEREAS, the City has previously issued its Sales Tax Revenue Bonds, Series 2001A (the “Series 2001A Bonds”), pursuant to the Seventh Supplemental Indenture (the “Seventh Supplemental Indenture”) dated as of March 1, 2001, between the City and the Trustee, and all of the Series 2001A Bonds have been paid or defeased;
WHEREAS, the City has previously issued its Sales Tax Revenue Refunding Bonds, Series 2001B (the “Series 2001B Bonds”), pursuant to the Seventh Supplemental Indenture (the “Seventh Supplemental Indenture”) to refund a portion of the Series 1993 Bonds, and all of the Series 2001B Bonds have been paid or defeased;
WHEREAS, the City has previously issued its Sales Tax Revenue Refunding Bonds, Series 2004 (the “Series 2004 Bonds”), pursuant to the Eighth Supplemental Indenture (the “Eighth Supplemental Indenture”) to refund the remaining portion of the outstanding Series 1993 Bonds, and all of the Series 2004 Bonds have been paid or defeased;
WHEREAS, the City has previously issued its Sales Tax Revenue Bond, Series 2006A (the “Series 2006A Bond”), pursuant to the Ninth Supplemental Indenture (the “Ninth Supplemental Indenture”) dated as of March 2, 2006, between the City and the Trustee, of which no bonds are currently outstanding;
WHEREAS, the City has previously issued its Sales Tax Revenue Bond, Series 2006B (the “Series 2006B Bond”), pursuant to the Tenth Supplemental Indenture (the “Tenth Supplemental Indenture”) dated as of April 10, 2006, between the City and the Trustee, and the lien on the Second Penny Tax as security for the Series 2006B Bond has been released as a result of a substitution of collateral, of which no bonds are currently outstanding;
WHEREAS, the City has previously issued its Sales Tax Revenue Bonds, Series 2007A-1 (the “Series 2007A-1 Bonds”), pursuant to the Eleventh Supplemental Indenture (the “Eleventh Supplemental Indenture”) dated as of May 1, 2007, between the City and the Trustee, which were refunded by the Series 2017A Bonds described below;
WHEREAS, the City has previously issued its Sales Tax Revenue Bonds, Series 2007A-2 (the “Series 2007A-2 Bonds”), pursuant to the Eleventh Supplemental Indenture (the “Eleventh Supplemental Indenture”) dated as of May 1, 2007, between the City and the Trustee, of which no bonds are currently outstanding;

WHEREAS, the City has previously issued its Sales Tax Revenue Refunding Bonds, Series 2018A (the “Series 2018A Bonds”) pursuant to the Fourth Supplemental Indenture to the First Amended and Restated Indenture of Trust dated as of March 1, 2018, between the City and the Trustee (the “Fourth A/R Supplemental Indenture”);
WHEREAS, the City has previously issued its Taxable Sales Tax Revenue Bonds, Series 2018B (the “Series 2018B Bonds”) pursuant to the Fifth Supplemental Indenture to the First Amended and Restated Indenture of Trust dated as of May 1, 2019, between the City and the Trustee (the “Fifth A/R Supplemental Indenture”);
WHEREAS, pursuant to a letter dated August 16, 2019, the Original Trustee has advised the City that it has sold its corporate trust business to U.S. Bank National Association, which has agreed to become successor Trustee (the “USBNA”), and USBNA has agreed to assume the obligations, duties, and trusts of the Trustee under the Amended and Restated Indenture;
WHEREAS, U.S. Bank Trust Company is the successor trustee to USBNA (the “Successor Trustee” and also referred to as the “Trustee”);
WHEREAS, the City has previously issued its Sales Tax Revenue Bonds, Series 2020A (the “Series 2020A Bonds”) pursuant to the Sixth Supplemental Indenture to the First Amended and Restated Indenture of Trust dated as of November 1, 2020, between the City and the Trustee (the “Sixth A/R Supplemental Indenture”, the First Amended and Restated Indenture of Trust as heretofore supplemented being referred to herein as the “Amended and Restated Indenture”);
WHEREAS, the Series 2012A Bonds, the Series 2016A Bonds, the Series 2017A Bonds, the Series 2018A Bonds, the Series 2018B Bonds and Series 2020A Bonds are currently outstanding and are payable on a parity as to principal, premium, if any, and interest from the pledged Second Penny Tax;
WHEREAS, subject to the conditions herein set forth the City has determined to issue one or more series of Sales Tax Revenue Bonds (collectively, the “New Series of Bonds”) to finance certain costs to renovate, equip, and/or furnish an existing recreation center at 8701 W. 32nd St. (the “West Side Aquatics and Recreation Center Project”); design, construct, equip, and/or furnish a new outdoor pool, pool house, parking lot(s), maintenance building, and other park and recreational on-site amenities at Kuehn Park (the “Kuehn Park Project”); design, construct, equip, and/or furnish a new recreation facility with an indoor pool, gymnasium, walking track, general community area, indoor children’s play equipment, parking lot(s), and other park and recreational on-site amenities at Frank Olson Park (the “Frank Olson Park Project”), and, subject to availability of funds, pay the costs of demolition of the existing pool and park-related structures together with site, street, utility, and related improvements, collectively the “Projects”;
WHEREAS, such Projects are necessary for the conduct of the City’s operation of its governmental programs and qualify under the Act, the City Charter, and the City ordinances as property and/or capital improvements, which may be financed by issuing its New Series of Bonds;
WHEREAS, the principal of, premium, if any, and interest on the Series 2012A Bonds, the Series 2016A Bonds, the Series 2017A Bonds, the Series 2018A Bonds, the Series 2018B Bonds, the Series 2020A Bonds, and any other Additional Bonds (including the New Series of Bonds, if and when issued) issued to finance or refinance Second Penny Tax Projects, as defined in the Amended and Restated Indenture of Trust, will be payable from any revenues produced as a result of the Second Penny Tax but not the Third Penny Tax;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
Section 1. The City finds that it is in the public interest and is desirable and expedient to finance the Projects, to authorize and deliver either (i) one or more Supplemental Indentures substantially in the form of the Sixth Supplemental Indenture of Trust dated as of November 1, 2020, (the “Sixth Supplemental Indenture”) consistent with the terms hereof, or (ii) a new indenture of trust (the “New Indenture”) consistent with the terms set forth herein and subject to the conditions set forth in Section 2(c) below, in each case with such changes as are approved by the Mayor, the City Clerk, the Director of Finance, and the City Attorney (together, the “Authorized Officers”), and to authorize, issue, and deliver the New Series of Bonds as provided herein. Terms not defined herein shall have the meanings assigned thereto in the Amended and Restated Indenture of Trust.
Section 2. There is hereby authorized to be issued the New Series of Bonds to be issued in one or more series to finance the Projects and other costs described below as follows:
(a) The principal amount of the New Series of Bonds may not be in an aggregate principal amount in excess of an amount sufficient (i) to fund a deposit of bond proceeds to a construction fund in an amount not to exceed $68,000,000 to pay costs associated with the Projects; (ii) to pay costs of issuance of such bonds; and (iii) to fund capitalized interest, if any, and a debt service reserve fund, if any, with the terms and subject to the provisions as set forth herein and as provided in the applicable indenture of trust.
(b) Subject to the determination set forth in Section 2(c) hereof, the New Series of Bonds will be payable either (i) on a parity as to principal, premium, if any, and interest from the pledged Second Penny Tax with the Series 2012A Bonds, the Series 2016A Bonds, the Series 2017A Bonds, the Series 2018A Bonds, the Series 2018B Bonds, the Series 2020A Bonds, and any other Additional Bonds outstanding under the Amended and Restated Indenture or (ii) as Subordinate Obligations (as defined in the Amended and Restated Indenture) payable as to principal, premium, if any, and interest from the pledged Second Penny Tax subject to the prior lien of the Amended and Restated Indenture pledged in favor of the Series 2012A Bonds, the Series 2016A Bonds, the Series 2017A Bonds, the Series 2018A Bonds, the Series 2018B Bonds, the Series 2020A Bonds, and on a parity with any other additional bonds issued and outstanding under the New Indenture.
(c) Prior to the issuance and sale of the New Series of Bonds, the Director of Finance, in consultation with the City’s Financial Advisor, shall determine whether it is in the City’s best financial interest to issue the New Series of Bonds as first lien Additional Bonds under the Amended and Restated Indenture or as Subordinated Obligations (as defined in the Amended and Restated Indenture) under a New Indenture secured by a lien on Pledged Sales Taxes subordinate to the lien of the Amended and Restated Indenture. The Finance Director shall be authorized to make such determination to issue the New Series of Bonds as Subordinated Obligations under a New Indenture if Moody’s Investors Service, Inc. assigns a rating of at least Aa1 to the New Series of Bonds to be issued under the New Indenture without provision for a debt service reserve fund. Any such determination by the Finance Director shall be final, binding, and conclusive upon the issuance, sale, and delivery of the New Series of Bonds.
(d) The City intends that the New Series of Bonds will qualify, in part, as “reimbursement bonds”, as defined in Treasury Regulation Section 1.150-2 or any successor thereto for the costs of the Projects heretofore incurred and paid with funds of the City within the period commencing 60 days prior to the date of the adoption of this Ordinance and any other costs as may be hereafter incurred and paid, such reimbursement to be made solely with proceeds of the New Series of Bonds if issued.
(e) The issuance of that portion of the New Series of Bonds, which are intended to fund the hard construction costs for the Frank Olson Park Project, shall not occur until the City Council has approved the schematic design and preliminary architectural plans for such Project.
Section 3. The Authorized Officers are authorized to prepare and distribute on behalf of the City a preliminary official statement and a final official statement (collectively, together with any supplements or amendments thereto, the “Official Statement”) for purposes of describing the New Series of Bonds, the Pledged Sales Taxes, the City, the Projects, and related matters concerning the New Series of Bonds and the security pledged with respect thereto. The Mayor and the Director of Finance (provided only one signature shall be sufficient) shall sign one or more copies of such final Official Statement on behalf of the City, and at least one such signed copy shall be filed with the permanent records of the City.
Section 4. The preparation and publication of the Official Notice of Sale and Bid Form substantially in the form utilized in connection with the Series 2020A Bonds subject to such modifications as the Authorized Officers deem necessary or appropriate in view of current market conditions (the “Notice of Sale”), and all actions heretofore or hereafter taken by the Authorized Officers and PFM Financial Advisors LLC, as financial advisor to the City (the “Financial Advisor”), are all hereby ratified and approved, subject to the following:
(a) The New Series of Bonds shall be sold to the lowest responsible bidder (the “Purchaser”) submitting a bid in response to the Notice of Sale, as shall be selected by the Authorized Officers, in consultation with the Financial Advisor. The Authorized Officers are hereby expressly authorized to select the Purchaser and accept the bid submitted by the Purchaser as provided herein, subject to the parameters set forth in Section 4 of this Ordinance, and the Authorized Officers shall also be authorized to waive any irregularities in any bid or to reject any and all bids.
(b) Before selecting the Purchaser and accepting the lowest responsive bid for any New Series of Bonds, the Authorized Officers shall first determine (i) the stated final maturity date for the New Series of Bonds, which date shall not be later than November 15, 2045; (ii) the maximum principal amount of the New Series of Bonds is not greater than the amount necessary to fund deposits to the construction fund of not more than $68,000,000 for the Projects plus amounts necessary to fund any necessary amounts for costs of issuance, capitalized interest, and deposits to the Debt Service Reserve Fund, if any; (iii) the interest payment dates relating to the New Series of Bonds; (iv) that the interest rate will be such that the overall true interest cost will not exceed 6 percent (6.0%) for the New Series of Bonds; (v) that the New Series of Bonds will have serial maturities (or mandatory sinking fund requirements) such that the average annual scheduled debt service on the New Series of Bonds will be substantially level, subject to adjustments to take into account debt service on the City’s outstanding sales tax revenue bonds, other expected expenditures from the City’s Second Penny Tax, and other available revenues; (vi) that the purchase price to be paid by the Purchaser is not less than the 99 percent of the par amount of the New Series of Bonds; and (vii) that the bid is otherwise in compliance with the provisions set forth in the Notice of Sale subject to any express waiver therefrom approved by such Authorized Officers and set forth in the Notification of Sale (defined below) to be signed by the Authorized Officers and filed by the City Clerk with the official records of the City Council promptly upon completion of the sale of the New Series of Bonds. Any such selection and determinations shall be included in the Notification of Sale.
(c) All determinations by any Authorized Officer as may be contemplated by this Bond Ordinance, whether included in the Notification of Sale or otherwise, shall be deemed conclusive evidence of such determinations and binding upon the City for all purposes.
(d) The New Series of Bonds shall be issued as fully registered bonds, shall be of the denomination of $5,000 each, and any integral multiple of $5,000, numbered from one upwards, and shall be in such amount, mature on the dates, and bear interest per annum payable semiannually on the dates specified by the Authorized Officers when they accept the bid by the Purchaser as shall be set forth in a bond order or notification of sale (the “Notification of Sale”) to be filed by the City Clerk with the City and the official records of the City Council. Further, the Authorized Officers shall be authorized to designate, at their option, the New Series of Bonds by date, letter, and/or other means to distinguish such series of bonds from other series of bonds issued or to be issued by the City.
Section 5. In connection with the authorization, issuance, and delivery of the New Series of Bonds, the Authorized Officers are authorized to enter into, execute, and deliver the following documents, instruments, and agreements as may be deemed necessary or appropriate by the City Attorney, consistent with the terms of this Ordinance:
(a) Either a New Indenture as provided in Section 2(c) of this Ordinance or (b) one or more Supplemental Indentures providing for the issuance of the New Series of Bonds.
(b) The New Series of Bonds.
(c) Bond purchase agreements or similar agreements with the Purchaser(s) of the New Series of Bonds providing for the sale thereof in conformance with the terms set forth above.
(d) Continuing disclosure agreements or undertakings satisfying the requirements of Rule 15c2-12 adopted by the Securities and Exchange Commission under the Securities Exchange Act of 1934, as amended.
(e) Official Statement(s).
(f) Such other documents, agreements, or instruments as may be necessary to make covenants and recite facts required to demonstrate the validity and enforceability of the New Series of Bonds under the laws of the state of South Dakota and (but only if the New Series of Bonds are issued as tax-exempt obligations) to ensure the exclusion of the interest thereon from the gross income of the owner of the New Series of Bonds under the Internal Revenue Code of 1986, as amended, and to effectuate the terms and intent of this Ordinance.
The execution and delivery of all such indentures, agreements, documents, and instruments is hereby authorized and directed, all of such indentures, agreements, documents, and instruments to be in such form and to contain such terms, consistent with this Ordinance, as the officers of the City designated herein determine to be necessary and desirable.
Section 6. Proceeds of the New Series of Bonds, together with all investment earnings accrued thereon, may be used to pay costs of the Projects, and any accounting, legal, or other professional and all other costs of issuance, capitalized interest, if any, and debt service reserve funds, and by this Ordinance such proceeds of the New Series of Bonds and investment earnings accrued thereon are specifically appropriated for the purposes set forth herein, provided, however, the amount of bond proceeds and investment earnings thereon spent on (1) the Frank Olson Park Project shall not vary by more than 5 percent from its currently estimated cost of $47,000,000 and (2) the Kuehn Park Project shall not vary by more than 5 percent from its currently estimated cost of $18,000,000, in each case, unless expressly approved by subsequent resolution or ordinance.
Section 7. If the New Series of Bonds are issued as Additional Bonds under a Supplemental Indenture, the Supplemental Indenture shall provide that the principal of, premium, if any, and interest on the New Series of Bonds will be payable from the revenues produced as a result of the Second Penny Tax under Section 10-52-2 of the Act on a parity with all other Outstanding Bonds. If the New Series of Bonds are issued as Subordinate Obligations under a New Indenture, the New Indenture shall provide that the principal of, premium, if any, and interest on the New Series of Bonds will be secured by and payable from the revenues produced as a result of the Second Penny Tax under Section 10-52-2 of the Act subject to the prior lien of the Amended and Restated Indenture.
Section 8. The City agrees and covenants that it will continue to impose and collect the pledged Second Penny Tax so long as any amounts owing under the New Series of Bonds are Outstanding.
Section 9. The City will publish this Ordinance. The City may not issue the New Series of Bonds authorized hereunder until this Ordinance is effective as provided by law.
Section 10. All prior resolutions or ordinances which conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.

This fall Southeast Technical College’s Director of Financial Aid Micah Hansen was named Most Valuable Professional (MVP) by the National Association of Student Financial Aid Administrators (NAFSAA). With 16 years of financial aid experience, Micah started his career at South Dakota State University and has worked at Globe University and Killian Community College. For six years he’s led STC’s financial aid department. Micah has extensive volunteer experience at the state and regional level. He’s served the South Dakota Association of Student Financial Aid Administrators (SDASFAA) Executive Council as president. He’s volunteered for multiple years with the Rocky Mountain Association of Student Financial Aid (RMASFAA) Summer Institute, and he’s developed and maintained the organization’s website for many years. This past October, Micah also spearheaded and hosted the RMASFAA annual conference that took place in Rapid City. This included scheduling details from booking the hotel and catering, securing quality speakers and exhibitors, scheduling entertainment, bussing attendees to Mount Rushmore for a field trip and a lot more.

STC provides a comprehensive program in the Dental Assisting profession and grants a diploma degree. Program graduates are eligible to apply for licensure as a Registered Dental Assistant, and in Dental Radiography and Nitrous Oxide Administration, to boards of dentistry. Graduates are eligible to take the Dental Assisting National Board (DANB). A full-time program director and a full-time instructor along with six adjunct faculty support students in their career progression. The dental assisting staff work with students to increase their knowledge and achieve competency in skills such as taking impressions making dental models and appliances, exposing radiographs, and working as a chairside assistant. The one-year program enrolls up to 36 students and provides dynamic and rigorous learning. The program was accredited in 2023 and has celebrated a retention rate of over 85% the past three years. Student placement consistently achieves 100% at tri-state clinical sites. The STC Dental Assisting program is Build Dakota scholarship eligible and enjoys an active and supportive advisory board committee that is comprised of clinical dentists and support staff. Action ST00881 Nicole McMillin and Megan Rothenberger provided the Counseling Services and Wellbeing Initiatives Report (MRF #648). Highlights of the report included the number of students seeking and engaging in counseling modalities July 1, 2024 to current and the Wellbeing Committee capacity building initiatives and preliminary offerings to students. Following general discussion, a motion was made by Nan Kelly and seconded by Gail Swenson, four (4) votes “yes” on roll call acknowledging the Counseling Services and Wellbeing Initiatives Report.
Action ST00882 President Cory Clasemann provided the Legislative Update Report (MRF #ST649). On December 3, 2024, SD Governor Kristi Noem presented the FY2026 Budget Address. The budget recommendation includes an increase in per student allocation, a decrease in maintenance and rehabilitation, a decrease in dual credit, and no one-time funding. Following general discussion, a motion was made by Marc Murren and seconded by Gail Swenson, four (4) votes “yes” on roll call acknowledging the Legislative Update Report.
Action ST00883 A motion was made by Gail Swenson and seconded by Nan Kelly, four (4) votes “yes” on roll call, approving the review of and/or revision of policies and the accompanying regulations (see MRF #ST650), as follows: BE/STC – School Board Meetings, ECA/STC – Video Surveillance, GBEAA/STC – Conflict of Interest, KLC/STC KLC-R/STC – Relations with Social Services, KLG/STC KLG-R/STC – Relations with Law Enforcement Authorities – School Resource Officers

Mayor Deborah McIsaac called the meeting to order at 6:01 PM in the Baltic City Hall, 130 St. Olaf Avenue. Answering roll call were City Attorney John Hughes, Alderman Ryan Sinding, Brian McGreevy, Mayor Deborah McIsaac, Nikki Oien and Steve Boeve. Also, in attendance were Public Works Supervisor Ryan Fods and Finance Officer Lacey Harrington.
Mayor McIsaac led the meeting in the Pledge of Allegiance.
The council reviewed the December 30, 2024 Regular Council Meeting minutes. Brian McGreevy made a motion to approve the December 30th minutes, Boeve seconded. All ayes, motion carried.

ORDINANCE 319 - SUPPLEMENTAL APPROPRIATIONS SECOND READING
Mayor McIsaac presented the Council with the 2nd reading of Ordinance 319 Supplemental Appropriations for 2024. Finance Officer Harrington advised that she needs to correct a misspelling in the document. Ryan Sinding made a motion to approve with the misspelling corrected, Boeve seconded. Notice is hereby given that the Lincoln County Board of Commissioners will hold a public hearings between 8:30 a.m. and adjournment of the January 28, 2025 Board of Commissioners meeting regarding an ordinance of Lincoln County, SD, changing the zone of the property described as Iken’s Tract 2, SW1/4 SW1/4, Section 21-T99N-R51W Perry Township from the A-1 Agricultural District to the C Commercial District and amending the Official Zoning Map of Lincoln County.

A RESOLUTION ADOPTING THE CONNECTING LINCOLN COUNTY 2050 COMPREHENSIVE PLAN AS PROVIDED FOR IN SDCL CHAPTER 11-2. WHEREAS, Chapter 11-2 of South Dakota Codified Law has empowered the Planning Commission and Board of Commissioners of Lincoln County to prepare a Comprehensive Plan for the development of the non-incorporated areas of the County; and
WHEREAS, the Lincoln County Planning Commission has developed the Connecting Lincoln County 2050 Comprehensive Plan for the future land development of Lincoln County, has held the required Public Hearing, and has made a recommendation for adoption of the Plan to the Board of Commissioners; and WHEREAS, the Lincoln County Board of Commissioners has received the recommendation of the Planning Commission and has held the required Public Hearing; and
WHEREAS, the adoption of the Connecting Lincoln County 2050 Comprehensive Plan would enhance the responsible development of Lincoln County. NOW THEREFORE, BE IT RESOLVED by Lincoln County, South Dakota that the Connecting Lincoln County 2050 Comprehensive Plan be hereby adopted and effective upon twenty days after publication of the notice of adoption, with said plan to supersede the 2005 – 2025 Lincoln County Comprehensive Plan adopted December 6, 2005. YOU ARE HEREBY SUMMONED and required to answer the Complaint of the Plaintiffs, which was filed in the office of the Clerk of this Court, at Sioux Falls, Minnehaha County South Dakota, on the 12th day of December, 2024, and which prays for a judgment quieting the title to and a determination of all adverse claims against the premises described in said Complaint, situated in said Minnehaha County, and legally described to wit:
Lot Nineteen (19) in Block Three (3) of Vista Gardens Subdivision of the North 1021.8 Feet of the West Half of the Southwest Quarter (W1/2 SW 1/4) of Section 33, Township 101, Range 49 West of the Fifth Principal Meridian, Minnehaha County, South Dakota according to the recorded plat thereof.
and to serve a copy of your Answer to said Complaint on the undersigned Attorney’s for the Plaintiff, namely Stacey R. Hennen and Jacob J. Samp, Samp Law Offices, whose address is P.O. Box 495, Sioux Falls, South Dakota 57101, within thirty (30) days after the completed service of this Summons upon you, exclusive of the day of service; and if you fail to answer said Complaint within that time, the Plaintiffs will apply to the Court for the relief demanded in the Complaint.
No personal claim is made against the Defendants herein named.
