The City of Sioux Falls has adopted a Disadvantaged Business Enterprise Plan. This Plan expresses the commitment of the City of Sioux Falls that disadvantaged business enterprises have the maximum opportunity to compete for and perform federally assisted contracts and subcontracts.
The City of Sioux Falls has available the latest Disadvantaged Business Enterprise directory in the Finance Department to facilitate identifying those certified disadvantaged business enterprises within the state of South Dakota.
Bidders for this work will be required to comply with the President’s Executive Order Nos. 11246 as amended, 11518 and 11625 as amended. The requirements for bidders and contractors under these orders are explained in the specifications.
Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order 12138. The requirements for bidders and contractors under this regulation which concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Women’s Business Enterprises (WBE) are explained in the specifications. The DBE/MBE and WBE goals for participation in this contract in terms of percentage of contract value are as follows: MBE 1.0 percent; WBE 4.0 percent.
Only firms certified at the time of the letting and included on the DBE Directory at dot.sd.gov, will count toward DBE participation.
Davis Bacon and Related Acts wages apply to this project. All provisions relative to those Acts must be met.
All bidders must be registered in the System for Award Management (SAM.gov), provide their Unique Entity Id (UEI), and have an active status.
To be considered a responsive bidder, the bidder must certify to compliance with the American Iron and Steel provision of the Consolidated Appropriations Act of 2014. This certification form may be found on page AIS-21 of the State Revolving Fund (SRF) General Conditions and must be included in the bid proposal.
Please be advised that waivers or exemptions from the American Iron and Steel provision that cite International Trade Agreements DO NOT comply with the Consolidated Appropriations Act of 2014 as it applies to the SRF programs. Claims from suppliers that the American Iron and Steel provision do not apply to certain products based on the International Trade Agreement exemptions of the Consolidated Appropriations Act of 2014 will not be accepted.
The low responsive bidder must assure compliance with the requirements of Public Law 115-232, Section 889, Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment. Contractors must assure that telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities), and video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities) WILL NOT be supplied for the project.
Your special attention is invited to the attached Bidders Activity Report (BAR), Forms A and B, and Debar-2 form. The BAR form must be completed and submitted with your bid proposal, along with either Form A or Form B, and Debar-2 form. Failure to submit the Form BAR, appropriate form A or B, and Debar-2 form will cause the bid to be rejected. Completion of the Bidders Activity Report is necessary in order to fulfill the requirements of obtaining a complete list of contractors contacted with regard to this project, in accordance with 49 CFR 26.11c. Statistical information used from the Bidders Activity Report will be used in the calculation of the next year’s DBE goals. By completing Form A, you are advising the City how the contract goal will be met. Meredith Jarchow, Assistant Commission Administrative Officer, was present to report on the proposals received from the Argus Leader, Brandon Valley Journal, Garretson Gazette, Minnehaha Messenger, and the Dakota Scout for designation as official county newspapers. During the 2024 legislative session, SB 152 was approved which includes an annual rate increase of 2% or the index factor, whichever is less, for published legal notices. This will be effective each July 1 moving forward, and the rates provided by each publication for before July 1, 2025, and what the adjusted rates will be for after July 2025. The proposal from the Argus Leader includes a rate of $0.29 per line and $0.23 subsequent pre-July and a rate of $0.2958 per line and $0.2346 subsequent Post-July. The proposals from the Brandon Valley Journal, Garretson Gazette, and Minnehaha Messenger each included a rate of $0.3195 per line for minutes and $0.355 per line for other notes pre-July and a rate of $0.3258 per line for minutes and $0.362 per line for other notices Post-July. The proposal from the Dakota Scout includes a rate of $0.284 per line for minutes and $0.316 per line for other notices pre-July and a rate of $0.2897 per line minutes and $0.3223 per line for other notices Post-July. AUTHORIZING THE APPOINTMENT OF THE MINNEHAHA COUNTY CORONER
WHEREAS, the Legislature of the State of South Dakota adopted SDCL § 7-7-1.4 which established that the board of county commissioners in a county may appoint, by resolution, a coroner who shall serve at the pleasure of the board; and
WHEREAS, the Minnehaha County Board of Commissioners previously appointed Dr. Kenneth S. Snell, a duly qualified medical pathologist, to perform the duties of the Minnehaha County Coroner and to serve in the capacity of Medical Examiner for a one-year term in 2024; and
WHEREAS, the Minnehaha County Board of Commissioners wish to re-appoint Dr. Snell in 2025 to satisfy the intent of the statutes for Coroner; and
NOW THEREFORE, BE IT RESOLVED, that the Minnehaha County Board of Commissioners herby appoint Dr. Kenneth S. Snell as Coroner for Minnehaha County for a one-year term beginning on January 1, 2025 and ending on December 31, 2025.

COMMISSIONER SALARY
Tom Greco, Commission Administrative Officer, gave a briefing on the determination of the 2025 salary for the Minnehaha County Commissioners. To accommodate the payroll system, a salary of $36,358.40 for the non-chair Commissioners and $37,876.80 for the Chair would be a divisible number for the 26 pay periods in 2025. This would be an increase of 5.5% for the Commissioners. The payroll budget, as adopted in September 2024, already includes funds supporting a 3% increase for the Commissioners with a recognition that an additional increase could be absorbed through other budget sources. MEDICAL CANNABIS DISPENSARY LICENSE
Kym Christiansen, Commission Recorder, was present for the public hearing to consider the issuance of a Medical Cannabis Dispensary License in Minnehaha County. The Auditor’s Office received one application for the one available Medical Cannabis Dispensary License. The license would allow for the operations of a medical cannabis dispensary in rural Minnehaha County. The application was received from Genesis Farms, LLC. The dispensary location selected by the applicant required a Conditional Use Permit (CUP) to be issued to allow for the dispensary to be located at the requested location. The Minnehaha County Planning and Zoning Commission met on November 25, 2024, to consider the CUP application, which was subsequently approved. In addition, there were no appeals on filed regarding the CUP.
Chair Karsky asked for proponents and opponents to speak on the topic. Daniel Schuttloffel, proponent, spoke in support of the issuing of the license and provided an update regarding the plans for the business. There were no opponents in attendance to speak on the topic.

RURAL ACCESS INFRASTRUCTURE FUNDING AWARD
Jacob Maras, Interim Highway Superintendent, presented on the potential award of Rural Access Infrastructure Funding. The Rural Access Infrastructure Program was enacted during the 2021 South Dakota Legislative session with an initial allocation of $25 Million to be awarded through FY2024. As part of the program, Minnehaha County currently has $942,554.87 available to award for eligible projects. Edison, Grand Meadow, Logan, Red Rock, Split Rock, Valley Springs, and Wall Lake Townships submitted applications for a total request of $1,289,036.00. Edison Township requested Rural Access Infrastructure Funding in the amount of $40,636.00 with a Township share of $10,158.00. Split Rock Township requested Rural Access Infrastructure Funding in the amount of $316,480.00 with a Township share of $79,120.00. Logan Township requested Rural Access Infrastructure Funding in the amount of $287,960.00 with a Township share of $71,990.00. Grand Meadow requested Rural Access Infrastructure Funding in the amount of $263,120.00 with a Township share of $65,780.00. Wall Lake Township requested Rural Access Infrastructure Funding in the amount of $24,000.00 with a Township share of $6.000.00. Valley Springs requested Rural Access Infrastructure Funding in the amount of $11,680.00 with a Township share of $2.920.00. Red Rock Township requested Rural Access Infrastructure Funding in the amount of $297,160.00 with a Township share of $74,290.00. COUNCIL SPECIAL YEAR END MEETING

Mayor Deborah McIsaac called the meeting to order at 6:02 PM in the Baltic City Hall, 130 St. Olaf Avenue. Answering roll call were City Attorney John Hughes, Alderman Brian McGreevy, Mayor Deborah McIsaac, Alderman Steve Boeve, and Nikki Oien. Missing was Alderman Ryan Sinding. Also, in attendance were Public Works Supervisor Ryan Fods and Finance Officer Lacey Harrington.
Mayor McIsaac led the meeting in the Pledge of Allegiance.
Mayor McIsaac requested the Council’s approval for Steve Bott to speak on an issue, which was granted. Bott expressed an issue with the current speed limit on Lovely Ave, advocating for an increase to 30-35 mph. The Mayor noted that many residents oppose raising the limit due to safety concerns for children near the school and businesses in the area. He also informed Bott of the steps required to formally present a case for the Council’s review.
The council reviewed the December 18, 2024 Regular Council Meeting minutes. Attorney Hughes pointed out that the minutes incorrectly stated Parker Hamann from ISG was present, when it was Justin Heim representing ISG. Finance Officer Harrington confirmed she would correct the error. Brian McGreevy made a motion to approve the December 18th minutes, Boeve seconded. All ayes, motion carried.
Council reviewed the Claims Payable. Ryan Sinding made a motion to approve the Claims Payable, Nikki Oien seconded. All ayes, motion carried.
NEW BUSINESS
MANAGED SERVICES CONTRACT & HARDWARE UPDATE
Mayor McIsaac informed the Council about ongoing evaluations of the managed services contract and plans to migrate on-premise servers to the cloud. McIsaac requested permission to reconfigure hardware as needed under existing agreements. Nikki Oien suggested tabling the discussion until January for more information, and the Mayor agreed.
TAX ABATEMENT
Mayor McIsaac presented the Council with a tax abatement from Minnehaha County. This abatement is confidential. Brian McGreevy made a motion to recommend approval of the abatement, seconded by Boeve, all ayes, motion carried.
McGreevy motioned to go into executive session at 6:14 pm. Seconded by Boeve. All ayes.
Oien motioned to return from executive session at 6:27 pm. Seconded by Boeve. All ayes.
YEAR END REVIEW
The purpose of the meeting was to address year-end budget appropriations, reviewing overages and shortfalls to ensure proper allocation of funds. Lacey presented a comprehensive year-end budget review, noting that the total budget was $917,000, and the City came in under budget by $156,000. However, $67,000 in supplemental appropriations is required. Unused funds are earmarked for streets, parks, and special assessments, with part of the parks fund already allocated for a project next year.
ORDINANCE 319 – SUPPLEMENTAL APPROPRIATIONS ORDINANCE
Finance Officer Harrington presented the first reading of Ordinance 319, Supplemental Budget Appropriations. The second reading is scheduled for the January meeting.
LATE FEES
Mayor McIsaac presented a proposal to increase water late fees at the request of Alderman Nikki Oien. Attorney Hughes is reviewing the legality and ordinance compliance. Oien moved to raise the late fee from $10.00 to $25.00, pending Attorney Hughes’ approval, Boeve seconded, all ayes, motion passes.
WATER, GARBAGE & SEWER RATES
Mayor McIsaac presented a proposal, prompted by Alderman Brian McGreevy, to consider a 5% increase in water, sewer, and potentially garbage fees for the coming year. The increase is intended to prepare for costly upcoming projects, including sewer improvements and a future water tower. McGreevy noted that the City currently has the lowest water and sewer rates in Minnehaha County and emphasized the importance of incremental increases to reduce the financial burden of larger future surcharges. The Council discussed the need to communicate the purpose of the increases, ensuring residents understand the funding is necessary for critical infrastructure projects. No motion was made, but the Council agreed to keep the matter under consideration and to provide public notices and information inserts with water bills.
PERSONNEL SALARY & PAYROLL RESOLUTION
Mayor McIsaac recommended a 5% annual salary increase for Ryan Fods, Lacey Harrington, and all elected officials. McGreevy made a motion to approve, Oien seconded, all ayes, motion passes. McGreevy added the need for incremental increases for these elected officials to make the role more appealing for individuals willing to dedicate their personal time to this work.
With no further business to discuss, Boeve made a motion to adjourn at 6:41 pm. Seconded by McGreevy, all ayes, motion carried.

THE STATE OF SOUTH DAKOTA TO THE ABOVE-NAMED DEFENDANTS:
YOU ARE HEREBY SUMMONED and required to answer the Complaint of the Plaintiffs, which was filed in the office of the Clerk of this Court, at Sioux Falls, Minnehaha County South Dakota, on the 12th day of December, 2024, and which prays for a judgment quieting the title to and a determination of all adverse claims against the premises described in said Complaint, situated in said Minnehaha County, and legally described to wit:
Lot Nineteen (19) in Block Three (3) of Vista Gardens Subdivision of the North 1021.8 Feet of the West Half of the Southwest Quarter (W1/2 SW 1/4) of Section 33, Township 101, Range 49 West of the Fifth Principal Meridian, Minnehaha County, South Dakota according to the recorded plat thereof.
and to serve a copy of your Answer to said Complaint on the undersigned Attorney’s for the Plaintiff, namely Stacey R. Hennen and Jacob J. Samp, Samp Law Offices, whose address is P.O. Box 495, Sioux Falls, South Dakota 57101, within thirty (30) days after the completed service of this Summons upon you, exclusive of the day of service; and if you fail to answer said Complaint within that time, the Plaintiffs will apply to the Court for the relief demanded in the Complaint.
No personal claim is made against the Defendants herein named.
