RESOLUTION NO. 127-24
A RESOLUTION ISSUING AN ON-SALE LIQUOR LICENSE FOR USE AT JACOBSON PLAZA.
WHEREAS, the City of Sioux Falls is the owner of Jacobson Plaza at Falls Park, located at 800 N. Phillips Ave., Sioux Falls, SD 57104, referred to in this Agreement as “Jacobson Plaza”; and
WHEREAS, the Jacobson Plaza skate ribbon, gathering hall, and warming house substantial completion date is anticipated in the winter of 2024–2025; and
WHEREAS, open year-round, Jacobson Plaza is a vibrant and multifaceted park designed to enrich the recreational and social fabric of the city. Jacobson Plaza will feature several amenities that include a state-of-the-art skate ribbon, the largest inclusive playground in the region, T. Denny Sanford Splash Pad, Pawsible Dog Park, an on-site warming house with a party room that can be arranged in multiple configurations and is appropriate for parties, small corporate gatherings, and other private events, along with a connected gathering hall with outdoor seating, and a common space area with public restrooms between the gathering hall and flexible use warming house; and
WHEREAS, Washington Pavilion Management, Inc. is engaged in, among other things, the business of managing and operating food, beverage (alcoholic and nonalcoholic), novelty, and merchandise concession services and catering services at the Washington Pavilion and Orpheum Theater; and
WHEREAS, Washington Pavilion Management, Inc. entered a four-and-a-half-year Food and Beverage Services Agreement (the “Agreement”) for the management, operation, and branding of the food and beverage services at Jacobson Plaza; and
WHEREAS, the Agreement commences December 12, 2024, whereby Washington Pavilion Management, Inc. will provide all food and beverage services at the gathering hall with outdoor seating, the party room within the warming house, the flexible use space at Jacobson Plaza, and concession sales and catering sales within Jacobson Plaza; and
WHEREAS, Section 111.014.1 of the Code of Ordinances of Sioux Falls, SD (the “Code”) provides that the governing body of a municipality may, by resolution, issue an on-sale liquor license to be used at any municipality-owned entertainment venue, event venue, event center, arena, performance hall, theater, outdoor amphitheater, convention center, stadium, athletic venue, recreation facility, municipal auditorium, or public convention hall; and
WHEREAS, pursuant to Section 111.014.1 of the Code, the City desires to issue an on-sale liquor license for use at Jacobson Plaza; and
WHEREAS, such on-sale liquor license shall be used to support the public purposes of Jacobson Plaza, which include but are not limited to serving the amenities and users of Jacobson Plaza at Falls Park, hosting entertainment and recreational events, as well as catering and concession sales, parties, meetings, banquets, graduations, small corporate events, private events, and other scheduled gatherings and events.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That the City hereby issues an on-sale liquor license to be used at Jacobson Plaza at no fee.
Section 2. That the City may contract with Washington Pavilion Management, Inc. and its successors or assignees for purposes of providing food and beverage services at Jacobson Plaza and to use the license issued.
Section 3. That Washington Pavilion Management, Inc. may not transfer such license.
Section 4. That no video lottery may be placed at Jacobson Plaza.

A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A CONSTRUCTION MANAGER AT-RISK AGREEMENT BETWEEN THE CITY OF SIOUX FALLS AND FIEGEN CONSTRUCTION CO., FOR CONSTRUCTION MANAGER AT-RISK SERVICES FOR A LIGHT, POWER, AND TRAFFIC OPERATIONS FACILITY ALONG WITH OTHER DOCUMENTS, AMENDMENTS, CHANGE ORDERS, OR OTHER INSTRUMENTS AS MAY BE DEEMED NECESSARY AND APPROPRIATE CONSISTENT WITH THE TERMS OF THE AGREEMENT.
WHEREAS, on October 20, 2023, the City of Sioux Falls (the “City”) requested proposals for Construction Manager At-Risk Services for a Light, Power, and Traffic Operations Facility located in Sioux Falls, SD; and
WHEREAS, as a result of the request for proposal process, the City selected Fiegen Construction Co., to provide Construction Manager At-Risk Services;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That the documents for Construction Manager At-Risk Services between the City and Fiegen Construction Co., (the “Agreement”), substantially in the form attached hereto and made a part of this resolution, are hereby approved.
Section 2. That the Mayor is authorized to sign such Agreement after it is ratified and executed by Fiegen Construction Co.
Section 3. In connection with the authorization of the Agreement, the Mayor, City Clerk, Finance Director, Public Works Director or his designee, City Attorney, and other officers of the City shall be authorized to enter into, execute, and deliver the Agreement and the following documents, instruments, and agreements as may be deemed necessary by the parties, consistent with the terms of the Agreement that do not exceed the authorized project budget.
A. Amendments, change orders, and change directives to the Agreement;
B. Insertion of exhibits into the Agreement that are mutually agreed upon by the parties; and
C. Other required documents or instruments that are mutually agreed upon by the parties pursuant to the Agreement.
The execution and delivery of all such amendments, change orders, change directives, exhibits, documents, and instruments is hereby authorized and directed to be in such form and to contain such terms, consistent with this resolution, as the officers of the City designated herein shall determine to be necessary and desirable.
Section 4. Change orders shall be executed and noticed in accordance with local and state law.
Section 5. That the City shall publish this resolution, without attachments, after its passage. The attachments are on file and available for inspection in the office of the City Clerk.

A RESOLUTION DECLARING CERTAIN EQUIPMENT OF THE CITY SURPLUS AND AUTHORIZING THE GIFTING TO THE CITY OF BALTIC, SD.
WHEREAS, the City owns a 2012 Smithco Ballfield Groomer, Asset #3016277, and a 2013 Smithco Ballfield Groomer, Asset #3017549; and
WHEREAS, pursuant to SDCL 6-5-2, any political subdivision may convey and transfer any real or personal property which is held or owned by it, the title to which has been obtained and which is not held for public use or which is about to be abandoned for public purposes, to another political subdivision or nonprofit corporation for public, charitable, or humanitarian purposes and accommodation without offering the property for sale and without requiring the political subdivision or nonprofit corporation to pay for the property; and
WHEREAS, pursuant to SDCL 6-13-1, the governing board of a political subdivision may sell, trade, loan, destroy, or otherwise dispose of any land, structures, equipment, or other property which the governing board has, by appropriate motion, determined is no longer necessary, useful, or suitable for the purpose for which it was acquired; and
WHEREAS, the above-described personal property is no longer necessary, useful, or suitable for the purpose for which it was acquired by the City and has been declared as surplus; and
WHEREAS, the City of Baltic, SD, finds it desirable to acquire said property; and
WHEREAS, the City of Baltic is a political subdivision of the State of South Dakota;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That the recitals above are adopted and are incorporated herein by this reference as if set out in full.
Section 2. That, pursuant to SDCL Chapter 6-13, the two Smithco Ballfield Groomers identified above are surplus property that is no longer necessary, useful, or suitable for the purpose for which they were acquired.
Section 3. That the gifting for a public purpose by the City of Sioux Falls of the two Smithco Ballfield Groomers to the City of Baltic, SD, is hereby approved.

RESOLUTION NO. 133-24
A RESOLUTION ESTABLISHING THE CITY OF SIOUX FALLS’ LEGISLATIVE PRIORITIES FOR THE 2025 STATE LEGISLATIVE SESSION.
WHEREAS, the City Charter states that the Sioux Falls City Council is the policy making and legislative body of the City of Sioux Falls;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
1. The Sioux Falls City Council supports prudent state investments to increase municipal water resources, including the proposed $1 million appropriation funding Dakota Mainstem engineering and assessment planning.
2. The Sioux Falls City Council recognizes the essential role that South Dakota’s airports have in our state’s growing economy. Locally, the Sioux Falls Regional Airport’s passenger total is projected to reach a record 1.35 million passengers in 2024, exceeding last year’s passenger record. To meet this growing regional demand for air travel, the airport is proposing to construct a new concourse that will provide five new gates to expand air service for the region. We urge the legislature to appropriate the necessary funds to be used in combination with federal funds to allow this significant terminal expansion project to move forward.
3. The Sioux Falls City Council supports legislation that creates a regulatory environment that increases enrollment in the South Dakota Child Care Assistance Program.
4. The Sioux Falls City Council supports legislation that provides local law enforcement with the necessary tools to address motor vehicle violations, including but not limited to speed racing, reckless driving, and street takeovers.
5. The Sioux Falls City Council supports efforts to safeguard children and educators from deadly threats. The council, therefore, supports pragmatic, realistic legislation, including the proposed School Safety Grants, that provide vital resources and promote the best practices for school safety.

ORDINANCE NO. 105-24
AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING THE CODE OF ORDINANCES OF THE CITY BY REVISING CHAPTER 90: ANIMALS AND FOWL TO PROVIDE FOR CLARIFICATION ON THE STANDARDS USED TO DECLARE A DOG VICIOUS.
BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That Section 90.001 of the Code of Ordinances of Sioux Falls, SD, is hereby amended by adding the following definitions:
§ 90.001 DEFINITIONS.
CONTRIBUTING PACK BEHAVIOR. Actions of an animal, including but not limited to biting, that aid, aggravate, or incite other animals to bite, and the behavior, when considered on its own, would place a reasonable person in fear of serious injury or death.
SERIOUS INJURY. Physical injury, which creates a substantial risk of death, causes serious and prolonged disfigurement, prolonged impairment of health, or prolonged loss or impairment of the function of any bodily organ.
Section 2. That Section 90.003 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 90.003 RESTRICTED ANIMALS.
(a) An animal may be declared restricted by the chief of police or the attending physician of the victim of an animal bite or scratch may request the declaration under the following guidelines:
(1) An animal which in a vicious or terrorizing manner approaches in an apparent attitude of attack, or bites, inflicts injury, assaults, or otherwise attacks a person or other animal, upon the streets, sidewalks, or any public or private grounds or places.
(2) No animal may be declared restricted if the injury or damage is sustained to any person or animal who is committing a willful trespass or other tort upon premises occupied by the owner or keeper of the animal, or who was teasing, tormenting, abusing, or assaulting the animal, or was committing or attempting to commit a crime.
(3) An animal that has been previously declared by another jurisdiction if the circumstances leading to the declaration in the other jurisdiction would have been sufficient for a restricted declaration had the events occurred within the city of Sioux Falls.
(b) When the chief of police declares an animal restricted, the chief of police shall notify the owner of the declaration in writing that the animal must be registered as a restricted animal within 15 days after the receipt of the written notice. The notice shall be served either in person or by mailing the notice by certified mail.
(c) The owner of an animal that has been declared restricted shall make application to the animal control office to register the restricted animal and shall comply with the following:
(1) The owner of the animal shall notify animal control of any changes in the following:
A. Ownership of the animal;
B. Name, address, and telephone number of a new owner;
C. Address change of the owner or any change in where the animal is housed;
D. Any change in the health status of the animal; and
E. Death of the animal.
(2) If the animal is indoors, the animal shall be under the control of a person over 18 years old;
(3) If the animal is outdoors and attended, the animal shall be muzzled on a leash no longer than 6’ and under the control of a person over 18 years of age;
(4) If the animal is outdoors and unattended, the animal must be locked in an escape-proof kennel approved by animal control. Minimum standards shall include the following:
A. Fencing materials shall not have openings with a diameter of more than 2”. In the case of a wooden fence, the gaps shall not be more than 2”.
B. Any gates within the pen or structure shall be lockable and of a design to prevent the entry of children or the escape of the animal;
C. The required pen or structure shall have secure sides and a secure top. If the pen or structure has no bottom secured to the sides, the sides shall be imbedded into the ground or concrete;
D. The pen or structure shall protect the animal from the elements; and
E. The pen or structure may be required to have double exterior walls to prevent the insertion of fingers, hands, or other objects.
(5) The animal shall be permanently identified by injecting an identification microchip into the animal using standard veterinarian procedures and practices. The number and the veterinarian who injected the microchip are to be reported to animal control;
(6) A sign provided by or approved by animal control denoting a restricted animal shall be displayed on the kennel or enclosure and on a place visible from the sidewalk or road adjacent to the property where the animal is kept. Said sign must warn the public as follows:
WARNING. RESTRICTED DOG ON THIS PROPERTY. DOG IS ONLY ALLOWED OUT OF HOUSE OR PEN WITH LEASH AND MUZZLE. THIS DOG HAS BEEN DECLARED RESTRICTED UNDER CITY OF SIOUX FALLS ORDINANCE 90.003. REPORT VIOLATIONS TO SIOUX FALLS ANIMAL CONTROL (367-7000).
The sign must also include a picture or symbol that conveys the idea of a vicious dog to small children who cannot read;
(7) The owner shall carry $100,000 animal liability insurance covering the medical and/or veterinary costs resulting from the vicious actions or any other damage the animal may do or cause to be done. Proof of insurance shall be filed with animal control;
(8) The owner shall present proof of current rabies vaccination and current city license of the animal to animal control; and
(9) The owner shall present proof the animal has been altered to prevent reproduction to animal control.
(d) The restricted animal shall be impounded by animal control at the owner’s expense until a time as all provisions of division (c) above are complied with.
(e) If the conditions in division (c) above are not complied with, the animal shall be euthanized in a humane manner and proof of euthanasia filed with animal control.
(f) Any restricted animal not in compliance with this article shall be seized by the animal control officer or any police officer and impounded. If the animal cannot be captured, it may be destroyed. An animal control officer or any police officer may order the owner to deliver the animal to the animal shelter within 24 hours and the owner ordered to appear in court to show cause why this animal shall not be destroyed. If the owner of the animal fails to deliver the animal as ordered, the animal control officer or any police officer shall use those means as are necessary to impound the animal.
Section 3. That Section 90.003.1 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 90.003.1 VICIOUS ANIMALS.
(a) An animal may be declared vicious by the chief of police under the following minimum guidelines:
(1) An animal that, in a vicious or terrorizing manner, engages in contributing pack behavior or bites, inflicts injury to, assaults, or otherwise attacks a person or other animal upon the streets, sidewalks, or any public or private grounds or places, resulting in the death of the person or other animal.
(2) An animal that, in a vicious or terrorizing manner, engages in contributing pack behavior or bites, inflicts injury to, assaults, or otherwise attacks a person or other animal resulting in:
A. A bite wound with one to four punctures from a single bite with at least one puncture, of which estimates indicate that more than 50 percent of the length of the canine teeth entered the victim’s body;
B. Serious injury to the person or animal; or
C. A Level 4 or higher aggression incident on the Dunbar scale as set forth in § 90.003.2.
(3) An animal that has been previously declared in another jurisdiction if the circumstances leading to the declaration in the other jurisdiction would have been sufficient for a vicious declaration had the events occurred within the city of Sioux Falls.
(4) No animal may be declared vicious if the injury or damage is sustained to any person or animal who is committing a willful trespass or other tort upon premises occupied by the owner or keeper of the animal, or who was teasing, tormenting, abusing, or assaulting the animal, or was committing or attempting to commit a crime.
(b) When the chief of police declares an animal vicious, the chief of police shall notify the owner of the declaration in writing. The notice shall be served either in person or by mailing the notice by certified mail.
(c) It is unlawful for any person to own, harbor, or possess a vicious animal.
(d) Any animal declared vicious shall be euthanized in a humane manner and proof of euthanasia filed with animal control.
(e) Any animal declared vicious shall also have been deemed declared restricted for purposes of any administrative appeal.
Section 4. That Section 90.003.2 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 90.003.2 DUNBAR AGGRESSION ASSESSMENT SCALE.
(a) Level 1. Animal growls, lunges, or snarls, but no teeth touch skin. Mostly intimidation or threatening behavior.
(b) Level 2. Teeth touch skin but no puncture. May have red mark or minor bruise from the dog’s head or snout, may have minor scratches from paws/nails. Minor surface abrasions or lacerations.
(c) Level 3. Punctures one to three holes, single bite. No tearing or slashes. Victim not shaken side to side. Bruising.
(d) Level 3.5. Multiple Level 3 bites.
(e) Level 4. Two to four holes from a single bite, typically contact/puncture from more than canines, which may have considerable bruising, black bruising, tears or slashing wounds indicating animal clamped down and held or shook head from side to side.
(f) Level 5. Multiple bites at Level 4 or above. A concerted, repeated attack causing severe injury.
(g) Level 6. Victim dead.

AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING THE CODE OF ORDINANCES OF THE CITY BY REVISING CHAPTER 90: ANIMALS AND FOWL TO ALLOW FOR THE TRAPPING, STERILIZING, AND VACCINATING COMMUNITY CATS AND RETURNING THEM TO THEIR ORIGINAL LOCATION.
BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That Section 90.001 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 90.001 DEFINITIONS.
For the purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
ANIMAL CONTROL OFFICER. A person designated by the chief of police to work with law enforcement officials in the enforcement of this chapter.
ANIMAL SHELTER. A building and facilities therein approved by the chief of police and the health authority for the impounding of animals.
ANTI-ESCAPE. Any housing, fencing, or device that a guard dog cannot go over, under, through, or around.
APIARY. Any place where one or more colonies of honeybees are kept.
APPARENT ATTITUDE OF ATTACK. Threatening and overtly aggressive actions of an animal that places a reasonable person in imminent fear of bodily injury, including, but not limited to, snarling, growling, elevated or exaggerated noise, combined with an attack-ready body position when the animal is approached.
AT LARGE.
(1) An animal when off or away from the premises and not under the control of the owner, possessor, keeper, agent, servant, or a member of his or her immediate family by a leash.
(2) An animal when on the premises of the owner, possessor, keeper, agent, or servant if not attended by a competent person unless the animal is chained, restrained, enclosed, or confined in a manner preventing it from leaving the premises.
BEEKEEPER. A person who owns or has charge of one or more colonies of honeybees.
CHIEF OF POLICE. The chief officer of the city police department or his or her designee.
COLONY. The honeybees in any hive, including queens, workers, and drones.
COMMERCIAL PROPERTY.
(1) A portion of land or building zoned for or utilized for commercial or business uses, within the city, including temporary sites.
(2) Any vehicle utilized for commercial or business purposes within the city.
COMMUNITY CAT. A cat that is feral.
COMMUNITY CAT CAREGIVER. A person who, in accordance with this section, is approved by the Sioux Falls Area Humane Society, and provides care to a community cat, including, food, shelter and/or medical care, while not being considered the owner, harborer, controller, or keeper of the community cat.
DOMESTIC ANIMAL. Any animal that through long association with man has been bred to a degree that has resulted in genetic changes affecting the temperament, color, conformation, or other attributes of the species to an extent that makes it unique and different from wild individuals of its kind.
EARTIPPING. The removal of the 1/4-inch tip of a community cat’s ear, performed while the cat is under anesthesia, to identify the community cat as being sterilized and vaccinated for rabies.
EXOTIC ANIMAL. Any animal not occurring naturally in the United States either currently or historically. Alleged domestication of any exotic animal shall not affect its status under this definition.
FERAL ANIMAL. Any domestic animal that has gone wild.
FLYWAY BARRIER. A solid fence, wall, dense vegetation, or combination thereof that is at least six feet in height that requires the bees to fly over, rather than through the barrier.
FOWL. Chickens, ducks, geese, turkeys, pheasants, quail, partridge, guineas, or other like domestic birds.
GUARD DOG. Any dog that is utilized to protect commercial property, or is housed unattended on commercial property at any time other than normal business hours, except that the definition shall not apply to pet stores, boarding kennels, veterinary offices, and animal shelters.
HANDLER. A person who is responsible for and capable of controlling the operations of a guard dog.
HEALTH AUTHORITY. The health officer of the city or his or her authorized representative.
HIVE. Any frame hive, box hive, box, barrel, log gum, skep, or any other container that may be used as a domicile for honeybees.
HOBBY BEEKEEPER. A person who engages in hobby beekeeping.
HONEYBEES. Any insect stage of the common honeybee, Apis mellifera L. This definition excludes African subspecies and Africanized hybrids.
HOUSING. Any location where the guard dog is kept when not being utilized for protection purposes.
LEASH. A cord, thong, or chain, not to exceed six feet in length, by which an animal is controlled by the person accompanying it.
LIVESTOCK. Any species of animal other than fowl commonly used for food, fiber, or draft purposes.
NONDOMESTIC ANIMAL. Any animal that is not domestic.
OWNER. Any person harboring or keeping an animal and who is the head of the household of the residence or any adult residing thereat if any head of household is not present, or the person, owner, or manager in charge of the establishment or premises at which an animal remains or returns to.
PET. Any domestic animal kept in or near a household for the primary purpose of companionship for member(s) of the household and/or companionship for other such animals. This includes dogs, cats, guinea pigs, hamsters, rats, mice, ferrets, birds other than fowl, reptiles, amphibians, invertebrates, and species that a reasonable person would consider a pet. Fowl, rabbits, and livestock are not pets. The keeping of fowl, rabbits, or livestock including, but not limited to, swine, cattle, cows, sheep, horses, mules, or goats shall not be governed by this section of the code but shall be governed by other applicable sections of this code.
SLAUGHTER. The act of killing fowl, rabbits, livestock, or any other animal for the purpose of food.
STRAY OR ABANDONED ANIMAL. A domestic animal which, for the time being, has no identified owner. A feral animal is not a stray animal.
TRAP-NEUTER-RETURN. The process of humanely trapping, sterilizing, vaccinating for rabies, eartipping, microchipping a community cat, and returning them to their original location.
UNNATURAL FOOD SOURCE. Any amount of grain, fruit, vegetables, nuts, hay, salt, mineral, food blocks, or other similar edible material which has the effect of attracting deer for the purpose of eating the material. UNNATURAL FOOD SOURCE does not include growing plants or the natural remainders of the growing plants.
Section 2. That Section 90.002 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 90.002 RUNNING AT LARGE PROHIBITED.
(a) Except on property designated by the city as an animal off-leash area, it shall be unlawful for any person to have any animal which is owned, kept, harbored, or allowed to be habitually in or upon the premises occupied by him or her or under his or her control to be at large and to go in or upon the private premises of others or upon any public property.
(b) Any person convicted of subsection (a) more than two times in a 12-month period shall be considered a reckless owner. Any fine for a reckless owner shall, at a minimum, be double the usual fine for animal running at large. For purposes of this section, each prior conviction must occur on a separate date than the present charge and any other prior conviction.
(c) Community cats shall not be impounded for solely being at large.
Section 3. That Section 90.006 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 90.006 STRAY OR ABANDONED ANIMALS.
(a) No person shall harbor or keep any stray animals. Animals known to be strays shall be immediately reported to the animal control officer.
(b) No person shall put out any food for the purpose of feeding or attracting any stray or abandoned animal. The placing of food to capture stray or abandoned animals by animal control officers or for the purpose of turning the animal over to animal control is not prohibited.
Section 4. That Section 90.010 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 90.010 ABANDONING OF ANIMAL.
No person shall abandon an animal in the city. Authorized trap-neuter-return in accordance with this chapter is not abandoning an animal.
Section 5. That the Code of Ordinances of Sioux Falls, SD, is hereby amended by adding a section to be numbered 98.018 to read:
§ 90.018 COMMUNITY CAT INITIATIVE.
(a) A community cat that has undergone the process of trap-neuter-return and was trapped or received by a local shelter or animal control shall be returned by the community cat caregiver to the location where the cat was trapped unless veterinary care is necessary; exhibits symptoms of rabies; is declared a restricted or vicious animal pursuant to §§ 90.003 or 90.003.1; the community cat caregiver fails to pick up the ear tipped cat within a reasonable period of time; or the location of where the community cat was trapped is unknown.
(b) A community cat caregiver, who is approved by the Sioux Falls Area Humane Society, is empowered to reclaim impounded community cats without proof of ownership.
(c) Any community cat that has undergone the process of trap-neuter-return shall be permanently identified by injecting an identification microchip into the animal using standard veterinarian procedures and practices.
Section 6. That the Code of Ordinances of Sioux Falls, SD, is hereby amended by adding a section to be numbered 90.019 to read:
§ 90.019 SIOUX FALLS AREA HUMANE SOCIETY APPROVAL.
(a) It shall be unlawful for any person to engage in TRAP-NEUTER-RETURN without first being approved by the Sioux Falls Area Humane Society as a community cat caregiver.

The School Board of the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, was called into regular session, pursuant to due notice, on Monday, December 9, 2024, at
5:30 p.m. in the Instructional Planning Center, 201 East 38th Street, Sioux Falls, South Dakota, with the following members present: Nan Kelly, Marc Murren, Gail Swenson, Vice President Dawn Marie Johnson, and President, Carly Reiter. Absent: none. Dr. Jane Stavem, Superintendent of Schools, Todd Vik, Business Manager, and Brett Arenz, In-House Counsel, were also present.
DeeAnn Konrad, Community Relations Coordinator, presented Project Warm-Up creating blankets for those in need in Sioux Falls and our surrounding communities. Students from Lincoln High School’s Student Council announced it is hosting its first-ever Winter Carnival on December 14, 2024. This free event is designed for elementary-aged students to enjoy holiday-themed activities. Families are encouraged to bring an unwrapped toy to help students in need.

A. $3,341,406 grant from the office of Head Start. The funding will allow for the next five years to continue Head Start Programming within the school district for the at-risk (poverty/foster care/homeless) students age 3-5. Head Start gives these young students a preschool experience with focus on cognitive, language, motor, social-emotional, and adaptive skills. These skills better prepare students for kindergarten. The contact person for the grant is Erica Kogel.

The Sioux Falls Community Learning Centers (CLC) initiative continues to drive meaningful change, helping students unlock their full potential through a collaborative approach that offers extended academic learning, enrichment activities, life-skill development, college and career readiness skills, and family engagement.
Now in its second year, the CLC program serves roughly 1,800 elementary students across 22 school sites with consistent before-and after-school care and summer enrichment. Enrollment has remained steady compared to the previous year, while demand for financial support has increased significantly. Since July 2024, more than $1.3 million in scholarships has been allocated to support families. Additionally, the CLC recently awarded a contract to the Boys & Girls Clubs of the Sioux Empire to provide services at Marcella LeBeau Elementary, starting in the 2025-2026 school year.
At the middle school level, CLC programming is ready for growth. While no consistent before-and-after school care is currently available, the District offers interest-based
after-school clubs and grant-funded tutoring at some schools. The CLC has addressed these gaps by collaborating with community partners and donors to construct a dedicated facility at George McGovern Middle School. Scheduled for completion in Fall 2025, this space will significantly enhance after-school opportunities for middle school students.
High school programming has focused on discovery and collaboration over the past year. The CLC has supported events such as a journaling club for alternative placement for students and a virtual reality career exploration event. These efforts have laid the groundwork for future initiatives centered around college and career readiness and recreational activities.
Family and community engagement remains a cornerstone of the CLC’s mission. Events such as Health & Wellness Fairs and Housing Education sessions demonstrate how the District leverages school facilities and community partnerships to meet the needs of families.
The Community Learning Centers reflect the District’s commitment to fostering success both in and out of the classroom. With thoughtful planning and collaborative efforts, the CLC is well-positioned to expand its impact in the coming years.

The school board shall select the date of the election by resolution no later than the first regular meeting after January first of each year. …”
The Sioux Falls School District School Board will have two vacancies next year when the terms of Carly Reiter and Nan Kelly expire in July. In accordance with the Board Resolution passed July 10, 2023, which establishes four-year terms for all Board Members by 2028, the transition plan states that both 2025 vacancies shall be three-year terms (in 2028 they will be four-year terms). To fill the vacancies, the District must hold an election.
The school district is negotiating with Minnehaha County to help run the 2025 Sioux Falls School Board election.

2. Defendant NHEM is the owner of record of a mobile home located on the property, but has not lived there since the year 2010. Her current address is unknown. The trailer is a 1971 Belmont trailer, title number T79296. The most recent tenant was Anistacio, last name unknown. He vacated the property on or about October 15, 2024 indicating may return sometime in 2025 and requested Plaintiff to retain his personal property in the trailer. Due to the age and condition of the trailer, the estimated value of the trailer is $0.00. The tax assessed value of $1,100. It is a liability to Plaintiff due to the cost to move or dispose of it.
3. No party has paid lot rent for use of the real property since Plaintiff became owner of the property December 14, 2022.
5. Plaintiff is unable to move or dispose of the trailer without first obtaining a writ of possession and continues in possession of said premises after default in payment of said rent and without permission of Plaintiff.
WHEREFORE, Plaintiff prays judgment and writ of possession against Defendant as follows:
1. For the possession of said premises pursuant to the provisions of SDCL 21-16-10 and SDCL 21-54-15 thru 21;
2. For the Plaintiff’s costs, disbursements and attorney fees as allowed by law; and
