AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING CHAPTER 30: CITY COUNCIL, SUBCHAPTER: ORGANIZATION AND PROCEDURE, SECTION 30.015, ADDRESSING THE COUNCIL; TIME LIMIT. BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:

Section 1. That Section 30.015 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 30.015 ADDRESSING THE COUNCIL; TIME LIMIT.
(a) Public input shall be allowed for any item on the regular agenda. Each person addressing the city council shall step up to the microphone in front of the rail, shall give his or her name in an audible tone of voice for the record, and unless further time is granted by the presiding officer, shall be limited to three minutes on any ordinance receiving a first reading; and on the date of final adoption by the city council, five minutes shall be allowed. If the regular agenda item is quasi-judicial as defined by state law or a zoning ordinance, the private applicant shall be invited first to provide public input and allowed an additional three minutes for rebuttal following public input. Rebuttal by the applicant shall only be allowed to respond to earlier testimony provided during public input. The city council has the right to overrule the presiding officer’s use of discretion pursuant to Robert’s Rules of Order Newly Revised (latest edition).
(b) Notwithstanding division (a) above, the general public input portion of a city council meeting, held pursuant to § 30.001(b) will be limited to topics which do not involve those agenda items appearing earlier in the regular agenda as public input shall be received when that agenda item is up for discussion. Each person addressing the city council during the general public input portion shall be limited to three minutes.
(c) No person shall address the city council without first securing the permission of the mayor, or acting mayor, to do so.
(d) Electronic presentations with audio and video embedded within the electronic presentation shall not be allowed. Electronic presentations without audio and video embedded within the electronic presentation are only permitted during regular agenda items on the date of final adoption. The city council may adopt standards that govern the use of electronic presentations. This provision shall not be construed to restrict electronic or hardcopy photos from being presented by the public during a regular meeting.
(e) All remarks shall be addressed to the city council as a body and not to any member thereof.
(f) No person, other than the city council and the person having the floor, shall be permitted to enter into any discussion, either directly or through a member of the city council without the permission of the mayor or acting mayor.
(g) No question shall be asked of a city council member except through the mayor or acting mayor.
(h) No person, except city council members, shall address the council after a motion is made and seconded unless requested by a city council member.

AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING THE CODE OF ORDINANCES OF THE CITY BY REVISING CHAPTER 95: PARKS AND RECREATION, SUBCHAPTER FEES.
BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That Section 95.070 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 95.070 DEFINITIONS.
For the purposes of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ADULT. A person between the ages 18 and 64.
ANNUAL AQUATIC SEASON. Shall be effective from date of purchase for one 12-month period, and include the Midco Aquatic Center, outdoor aquatic centers, and outdoor swimming pools.
ANNUAL RECREATION CENTER PASS. Shall be effective from the date of purchase for one 12-month period and includes recreation centers.
CHILD. A person between the ages three and 17.
COUPLE. Two individuals, at least one of whom is over the age of 18, who reside in the same household.
FALL, WINTER, AND SPRING AQUATIC SEASON. All operational days at the Midco Aquatic Center excluding the summer aquatic season.
FALL, WINTER, AND SPRING REDUCED- INCOME. Families/individuals who are residents of Sioux Falls and who actively receive reduced or free school lunches, who actively receive Medicaid benefits, receive South Dakota Temporary Assistance for Needy Families (TANF), who presently have foster children residing in the household, or have an active Dakota EBT card–food stamp card.
FAMILY. Immediate family members living in the household, including step and foster children. It does not mean extended family such as grandparents, aunts, uncles, and children older than 18 years of age.
FREE PASS/FREE SEASON PASS. Families/individuals who are residents of Sioux Falls and have an active Dakota EBT card–food stamp card or receive South Dakota Temporary Assistance for Needy Families (TANF).
INDOOR AQUATIC FACILITY. An ADA accessible facility located within a recreation center that may include, but is not limited to, amenities such as a leisure pool, zero-depth beach entry, play features, water slides, lap lanes, and lazy river.
INFANT. A person between the ages zero to less than three years old.
MIDCO® AQUATIC CENTER. An indoor, ADA accessible facility that may include, but is not limited to, amenities such as leisure pool, zero-depth beach entry, play features, water slides, lap lanes, current channel, and diving boards.
MONTHLY RECREATION CENTER PASS. Shall be effective from the date of purchase in any calendar month to the corresponding day of the next month if such day exists, or if not, to the last day of the next month.
OUTDOOR AQUATIC CENTER. An ADA accessible facility that may include, but is not limited to, amenities such as leisure pool, zero-depth beach entry, play features, water slides, lap lanes, and lazy river. (Drake Springs, Laurel Oak, and Terrace Park.)
OUTDOOR SPRAY PARK. A standalone structure not part of the Midco Aquatic Center from which water is sprayed or released but does not accumulate.
OUTDOOR SWIMMING POOL. A pool of water with depths from two to 12 feet of water, which may include lap lanes and diving boards. (Frank Olson and Kuehn.)
OUTDOOR WADING POOL. A pool of water with a separate entrance that may include 36 inches or less of water depth and play features. (McKennan, Frank Olson, and Kuehn.)
RECREATION CENTER. An indoor, ADA accessible facility that may include, but is not limited to, amenities such as an indoor aquatic facility, gymnasium, multi-purpose space, walking/running track, and fitness space. A recreation center shall not include the Midco Aquatic Center.
REDUCED-INCOME. Families/individuals who are residents of Sioux Falls and actively receive reduced or free school lunches, or who actively receive Medicaid benefits, receive South Dakota Temporary Assistance for Needy Families (TANF), who presently have foster children residing in the household, or have an active Dakota EBT card–food stamp card.
RESIDENT OF SIOUX FALLS. Any person whose place of residence is within the city limits of Sioux Falls.
SENIOR CITIZEN. A person age 65 and older.
SPLASH PASS. A transferrable pass to be redeemed only toward the cost of admission at the Midco Aquatic Center, outdoor swimming pools and outdoor aquatic centers.
SUMMER AQUATIC SEASON. The season of operation generally between the months of May through August as established annually by Sioux Falls Parks and Recreation at the Midco Aquatic Center, indoor aquatic facilities, outdoor aquatic centers, and outdoor swimming pools.
VETERAN. An individual who has or is currently serving in the United States military and must provide documentation of service such as a Military ID.
Section 2. That Section 95.071 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:

ORDINANCE NO. 70-24
AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, APPROVING ASSIGMENT OF LEASES OF REAL PROPERTY AND EQUIPMENT.
WHEREAS, in 2007 City and County, having common interests and responsibilities to provide public safety communications within Minnehaha County and the area in and around the City of Sioux Falls, entered into a Joint Cooperative Agreement for Communication Services (“Cooperative Agreement”) under which the parties created Metro Communications Agency (“Metro”) pursuant to SDCL § 1-24-4(2); and
WHEREAS, the Cooperative Agreement was revised as the First Amended and Restated Joint Cooperative Agreement for Communication Services (effective January 1, 2011); and
WHEREAS, City and County have determined that it is in their mutual best interests to terminate the Cooperative Agreement, as amended, and enter into a new Joint Cooperative Agreement for Emergency Communications Services, under which the parties agreed that Metro would cease to exist as a separate legal entity effective on January 1, 2024, and shall thereafter be an office under the City; and
WHEREAS, SDCL Chpt. 1-24 authorizes public agencies, including counties and municipalities, to jointly exercise any powers, privileges, or authority that such public agencies are capable of exercising on their own; and
WHEREAS, SDCL Chpt. 6-5 authorizes counties and municipalities to exchange with each other and to transfer and convey from one to the other any land or property belonging to them and to perform and exchange work between themselves and pursuant to SDCL 1-24-2 such authority extends to a separate legal entity created under SDCL Chpt 1-24; and
WHEREAS, SDCL Chpt. 34-45 authorizes the governing bodies of two or more public agencies to enter into an agreement for the provision of a 911 system; and WHEREAS, County and City enter into this Transfer Agreement an assigning lease and conveying of equipment at the following locations:
“Hartford Site”:
A square plot of land, approximately 150ft by 150ft in dimension, located in Tract A, except Lot 1 in Tract A of Pearson’s Addition in the South Half (S1/2) of Section 2, Township 102 North, Range 51 West of the 5th P.M., Minnehaha County, South Dakota, according to the recorded plat thereof.
“Humbolt/ KKLS Site”:
The NW1/4, except Shumaker’s Addition and except the East 1,117.29 feet of the North 762.4 feet, in Section 16, Township 103 North, Range 52 West of the 5th P.M., Minnehaha County, South Dakota, AKA 45611 252nd St, Minnehaha County, South Dakota.

A RESOLUTION AUTHORIZING A SOUTHERN SIOUX FALLS AQUATICS COMMITTEE.
WHEREAS, Sioux Falls Parks and Recreation is nationally accredited and envisions providing a comprehensive mix of high-quality parks and recreation programs, facilities, and services that contribute to a quality of life that is unparalleled in the region; and
WHEREAS, there are six outdoor pools and aquatic centers, an indoor aquatic center, and two splash pads in Sioux Falls, but none exist south of 57th Street; and
WHEREAS, there are more than 32,000 Sioux Falls residents who reside south of 57th Street according to the U.S. census; and
WHEREAS, an aquatic center in southern Sioux Falls was identified as early as 2012 in the Aquatic Facility Master Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That a committee is hereby established to review, develop a financial plan, and recommend final location(s) for siting an outdoor aquatics center in southern Sioux Falls that could be constructed within the next five years.
Section 2. That the Mayor is hereby authorized to appoint a representative to the committee from Sioux Falls Parks and Recreation, Planning and Development Services, and Public Works, a Parks and Recreation Board Member, and a citizen representative from the community with real estate experience.
Section 3. The City Council Chair and Vice Chair shall appoint two City Council members to the committee.
Section 4. The committee shall approve and deliver final recommendations to the Mayor and City Council on or before Monday, December 2, 2024.
Section 5. The City Council intends to appropriate $500,000 for site acquisition, due diligence, and other preliminary design services.

The South Dakota Department of Transportation (SDDOT) with the Cities of Sioux Falls, Baltic, Dell Rapids, and Minnehaha County are hosting back-to-back Public Open Houses to gather public input to help shape the long-range vision of the corridor.
The purpose of this public open house is to gather input on issues and needs to be addressed as part of this study along the S.D. Highway 115 Corridor. This information will help the study team shape the long-range vision for the corridor and to provide implementation guidance for recommended improvements.
Project representatives will be available with displays to discuss the study and answer questions. During this time, participants will have the opportunity to submit written comments and participate in a roadway survey.
Area residents, business owners, and daily commuters are encouraged to attend and participate in the open house.
Notice is further given to individuals with disabilities that this public meeting is being held in a physically accessible place. Action ST00844 Vice President for Enrollment Management Megan Fischer and Academic Dean Jason Merritt presented the Summer 2024 Camps and Activities Report (MRF #ST623). Southeast Technical College has partnerships with CTE, USD, Avera, Sanford, Stockwell Engineers, ACEC and AGC as well as Brandon Valley High School and Harrisburg High School to help provide young people career and college exploration opportunities. STC hosted 330 students with career and college exploration opportunities in June and July. Upcoming and ongoing events for the 2024-2025 academic school year were also discussed. Following general discussion, a motion was made by Nan Kelly and seconded by Marc Murren, five (5) votes “yes” on roll call acknowledging the Summer 2024 Camps and Activities Report.
Action ST00845 Director of Institutional Effectiveness Jackie Pommer presented the Strategic Plan Update Report (MRF #624). Continuous Quality Improvement helps Southeast Technical College navigate the path necessary to fulfill our mission developed in 2016, To educate individuals for dynamic and rewarding careers that promote lifetime success and meet the workforce needs of our region. STC’s vision is to fulfill our mission with educational excellence for tomorrow’s workforce. Both the mission and vision were driving forces in developing “Vision 2025”, the STC three-year strategic plan. Vision 2025 Committees were created to align with each strategic priority and help the campus community carry out the important tactical work of realizing each goal under the six strategic priority areas. Recent adoption of the Watermark Planning and Self-Study system has allowed campus employees to enter and track yearly and overall progress toward strategic planning goals that help keep STC at the forefront in SD and the region.The report recapped the first two years of the STC strategic plan in the six strategic priority areas and associated goals and tactics of “Vision 2025”: 1. The School Board of the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, was called into regular session, pursuant to due notice, on Monday, August 12, 2024, at 5:30p.m. in the Instructional Planning Center, 201 East 38th Street, Sioux Falls, South Dakota, with the following members present: Nan Kelly, Marc Murren, Gail Swenson, and Vice President, Dawn Marie Johnson, and President, Carly Reiter. Ratifying the purchase of the real property located near Whittier Middle School from Jennifer Konze, as follows:
522 Fairfax Ave – Lot 11, Block 7, Dakota Improvement Cos 2nd Addition to the City of Sioux Falls, Minnehaha County, South Dakota; and

C10.Approval of Angel Fund Meal Assistance Program
Per Policy/Regulation EFD-R, approving the Angel Fund meal assistance program through the end of the first semester of 2024-25 School Year as follows:
Only students who have a Free and Reduced Application on file are eligible.
Students over 185 percent and up to 200 percent of poverty shall receive free breakfast and lunch via the Angel Fund.
Students over 200 percent and up to 215 percent of poverty shall receive three dollars of matching Angel Funds for every dollar contributed by the student.
Students over 215 percent and up to 230 percent of poverty shall receive one dollar of matching An-gel Funds for every three dollars contributed by the student.
All other restrictions contained in EFD-R apply.
The status of the Angel Fund balance and donor commitments will be re-evaluated in November to determine if funding is adequate to continue these guidelines beyond the first semester.

Sara Khlaahsen, Coordinator of K -12 EL and Staff Development, presented the Professional Devel-opment Report as follows (MRF#19437):
The Sioux Falls School District (SFSD) is dedicated to enhancing professional learning for all 3,600 employees. Professional development is an area of emphasis identified through the Sioux Falls School District Priorities. The weeks leading up to the beginning of the 2024-2025 school year includ-ed District-led in-services for all employee groups with job-specific training. In addition to District-planned professional development, principals provided building-specific training, health and safety protocols, emergency preparedness, and other targeted professional development.
Professional development activities aim to enhance staff capacity, emphasize ‘The Sioux Falls School District Experience,’ encourage self-reflection, and stimulate innovation, all of which will posi-tively influence student achievement. Opportunities are provided to every employee group, including custodians, clerical staff, educational assistants, related service providers, specialists, teachers, ad-ministrators, and substitute teachers.
Numerous groups received specialized training to build their leadership capabilities.
New administrators, interns, and instructional coaches participated in specific training programs de-signed to foster instructional leadership skills and strengthen the ability to provide precise and con-structive feedback that impacts student learning.
Staff development occurs frequently throughout the summer and leading up to the school year. Addi-tionally, in-service days are built in throughout the year to strengthen and reinforce best practices that ensure delivery of a high-quality education.

Dr. Nold, Assistant Superintendent, presented the Absenteeism Grant Report as follows (MRF#19438):
In 2023, the Sioux Falls School District received a three-year, $1.5 Million grant to address chronic absenteeism at six schools. Grant dollars paid for the hiring of six attendance liaisons and one aca-demic recovery teacher that was a split position at the middle schools to assist with academic learn-ing loss caused by excessive absenteeism. Four subgroups at each school were specifically identi-fied to focus on attendance improvement (homeless, economically disadvantaged, Hispanic, and Native American).
Data collected over the first year of implementation show a general movement in the right direction. Overall, the composite rate of attenders increased on all metrics and chronic absenteeism rates dropped. All four subgroups identified saw significant improvements in attendance. One school saw the first increase in attendance rates in five years, and that rate of increase was the third largest in terms of percentage attending over the last twenty-two years.
Many strategies were implemented to improve attendance - phone calls, texts, home
visits, school visits with family, incentives, and individual attendance plans. Incentives included con-tests, Flyboy Fridays, Chick-Fil-A Attendance Parties, attendance awards, lunch with a firefighter, and weekly drawings, just to name a few. Support structures included everything from rides to school to alarm clocks, bus passes to gas cards, and ‘nudge texts’ to school supplies.
As we move into the second year of implementation, we are working toward increasing visibility of the campaign by partnering with an advertising agency to get the message out. Liaisons will continue to utilize a hands-on approach with personal human contact. We will continue to assess the effective-ness of the grant and our intervention strategies for the 2024-25 school year.

Becky Dorman, Senior Director of Human Resources presented the Fall 2024 Staffing Update as follows (MRF#19439):
The Sioux Falls School District’s recruitment strategy hinges on innovative approaches and a com-mitment to the Staff Excellence framework of the District Priorities to attract and retain top teachers and support staff amid national staffing shortages. Notably, teacher turnover has slowed for Fall 2024, and teaching applications have increased.
As of early August, SFSD has welcomed 148 new teachers to our classrooms. Of this group, 66% have been teaching for less than five years, and 34% possess a master’s degree or higher. Com-pared to previous years, more teachers are coming from within the state, and 37% of the new teach-ers served the District in another capacity during the previous school year. Teacher diversity rates continue to see steady growth, with increases over the past six years. Fall 2024 welcomed 15.75% ethnically diverse teachers within our group of 148 new teachers, while District-wide, 6.5% of the teaching staff are considered ethnically diverse.
Social media and word of mouth referrals continue to be the most utilized tool for new hire recruit-ment. HR Specialists have created a recruitment and retention team to keep SFSD competitive in the job market. This team utilizes many tools to entice prospective employees to the District, including digital content, city-wide billboard campaigns, website designs, postcards, and certification tracking, just to name a few.
As the District welcomes all new staff this fall, the Human Resources Department will continue to pursue ways to support staff and elicit their feedback, emphasize staff diversity and retention efforts, and prepare for the next “hiring season” which begins again shortly after students enter our class-rooms this fall.

The Sioux Falls School District is requesting to apply a for a waiver from ARSD 24:28:16:02.01(3) Eligibility for reciprocity for international educators. The secretary may issue an educator certificate to an international applicant for reciprocity certificate, if the applicant:
Holds the U.S. equivalent of a bachelor’s degree or higher, as shown by a course-by-course creden-tial report of university-level credit completed by an agency approved by the Association of Interna-tional Credential Evaluators or the National Association of Credential Evaluation Services that states the course title, grade, and number of semester credit hours earned for each course and the U.S. equivalency of the degree earned;
Provides documentation showing completion of a program equivalent to a department-approved ed-ucator preparation program; and
Submits:
Documentation showing that the applicant holds a foreign educator credential in a teaching field comparable to a field recognized in South Dakota; or
Documentation, completed by the superintendent, principal, agency director, or designated personnel officer of the foreign school where the applicant is currently or was previously employed, showing that the applicant has at least three years of experience in the applicant’s certification area within the previous five calendar years.
The teachers impacted by this waiver application include the following:
Ana Baez Miguelez, Spanish Immersion science at Edison Middle School
Pablo Simón Caicoya, Spanish Immersion language arts at Lincoln High School
Maria Toscano, Spanish Immersion Kindergarten at Sonia Sotomayor Elementary
Cindy Gonzalez, first grade at Sonia Sotomayor Elementary. These teachers do not possess a for-eign educator credential, outside of their university diplomas, as foreign educator credentials are not required in their home countries. Additionally, they have less than three years of teaching experience within the previous five calendar years.

Notice is hereby given a Verified Petition for Adult Name Change has been filed by Hayat Abdourhman the object and prayer of which is to change Petitioner’s name from Hayat Abdourhman to Hiwet Desalegn Behone. On the 17 day of Sept., 2024, at the hour of 11:00am said verified petition will be heard by this Court before the Honorable Judge Hoffman Presiding, at the Court Room in the Minnehaha County Courthouse, City of Sioux Falls, Minnehaha County, South Dakota, or as soon thereafter as is convenient for the court.
