RESOLUTION NO. 20-25
A RESOLUTION APPROVING THE MEMORANDUM OF UNDERSTANDING AMENDING THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF SIOUX FALLS AND THE POLICE OFFICERS AND SERGEANTS, SIOUX FALLS FRATERNAL ORDER OF POLICE LODGE #1 L.C.
BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
1. That the Memorandum of Understanding (MOU) to the Collective Bargaining Agreement between the City of Sioux Falls and Lodge #1, Sioux Falls Fraternal Order of Police, providing for the terms and conditions of employment for the period from January 1, 2024, through December 31, 2025, is hereby approved by the City Council.
2. That the MOU specifically amends Article 30, Promotions, to remove the requirement that years of service to the Sioux Falls Police Department must be continuous prior to being eligible for promotion.
The amendment, as contained in the attached MOU, is hereby made part of this Resolution.

AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING THE CODE OF ORDINANCES OF THE CITY BY REVISING CHAPTER 51: UTILITY RATES AND CHARGES BY ADDING SECTION 51.081.03 SYSTEM CAPACITY CHARGE FOR WASTEWATER CUSTOMERS, AND AMENDING SECTION 51.082 FUNDS ESTABLISHED.
BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That the Code of Ordinances of Sioux Falls, SD, are hereby amended by adding a section to be numbered 51.081.03 to read:
§ 51.081.03 SYSTEM CAPACITY CHARGE FOR WASTEWATER CUSTOMERS.
As authorized by state law, a Wastewater System Capacity Charge (SCC) is hereby established for all Sioux Falls wastewater customers and shall be imposed upon all development and redevelopment within the city and joint jurisdiction areas for the purpose of recovering past capital costs and to fund an equitable share of the capital costs of developing new capacity for those developments and redevelopments that create the need for or increase the demands on wastewater capital infrastructure improvements.
(1) Definitions.
For purposes of this section, the following mean:
(a) CAPITAL COSTS shall include:
i. Costs of construction or expansion of infrastructure that is necessary to serve a new development or redevelopment, including the design, surveying, engineering, environmental, and other professional fees that are directly related to the construction or expansion of the POTW;
ii. Land acquisition costs, including the purchase of interest in land, any court award or settlement, appraisal, relocation service, negotiation service, title insurance, expert witness, attorney, and other professional fees that are directly related to the land acquisition;
iii. Debt service;
iv. Rate of return, including a risk premium for any potential default; and
v. Directly related expenses incurred in preparing or updating the comprehensive plan or zone improvement plan, including all administrative, consulting, attorney, and other professional fees.
(b) DEVELOPMENT means the construction, reconstruction, conversion, structural alteration, relocation, or enlargement of any structure; any mining, excavation, landfill, or land disturbance; or any use or extension of the use of land resulting in placement of a water meter or the change in water meter size, including change in meter size during redevelopment, renovation, or other alteration of water meter size.
(c) OWNER means the owner or owners of record title or the purchaser or purchasers under a recorded land sales agreement and other persons having an interest of record in the described real property.
(d) PUBLICLY OWNED TREATMENT WORKS (POTW) shall mean any wastewater treatment plant owned and operated by the city including all devices and systems used in the collection, storage, treatment, recycling, and reclamation of wastewater or industrial waste and any conveyances that transport wastewater to the plant.
(e) SINGLE-FAMILY DWELLING means for this section, a dwelling that is designed for and occupied by not more than one family and is surrounded by yards and is not attached to any other dwelling by any means.
(f) WASTEWATER SYSTEM CAPACITY CHARGE (SCC) does not include:
i. Any fees assessed or collected as part of an existing cost recovery area;
ii. A charge, fee, or assessment collected pursuant to city assessment or tax increment financing district;
iii. The cost of complying with requirements or conditions of development agreements, finance agreements, or any other agreement as may exist between the city and any owner.
(2) Wastewater System Capacity Charge (SCC) established.
(a) The Wastewater SCC shall be charged for all installations of a city water meter, which includes a change in meter size due to redevelopment, renovation, or any other actions that may alter the water meter size, increased usage of a capital improvement, connection to the city’s sanitary sewer system, and upon all development or redevelopment within the joint jurisdiction boundary of the city that connects to or otherwise uses the city’s POTW.
(b) Wastewater SCCs shall not be expended for costs of the operation or routine maintenance of city wastewater capital improvements.
(3) Wastewater System Capacity Charge (SCC) rates.
a) The amount of the Wastewater SCCs shall be established from time to time by the city via ordinance, which ordinances, as amended from time to time, are hereby incorporated herein by reference. The Wastewater SCC shall be based on the number and size of water meters. The following table indicates the Wastewater SCCs based on water meter size:

b) Wastewater SCC credits will be provided based on the difference in the Wastewater SCC amount for meter(s) that are removed and replaced with larger meter(s) in cases of redevelopment or increased service requirements. Credits will not be granted for decreased capacity use or reductions in water meter size.
c) Any Wastewater SCC credit must stay with the property of origin and may not be transferred to another property, sold, or otherwise transferred.

a) Wastewater SCCs will be collected based on the implementation table in subsection 4 for connections located in city sanitary sewer cost recovery areas in years 2026, 2027, and 2028.
b) All city sanitary sewer cost recovery areas shall be terminated on January 1, 2029, and thereafter city cost recovery fees shall not be collected by the city.
c) Property that paid the cost recovery fees prior to December 31, 2028, will be eligible to pay the Wastewater SCC phase-in rates in the table in subsection 4 until December 31, 2029. Service connections completed on or after January 1, 2030, will be charged the Wastewater SCC outlined in subsection 3.
d) Property that did not pay the cost recovery fees prior to December 31, 2028, will be charged the Wastewater SCC outlined in subsection 3.
(5) Calculated Wastewater SCCs.
a. Wastewater SCCs shall be calculated on an equivalent flow basis for any combination of meters 3 inches in diameter and greater for primary forms WM1 (Warehouse and Manufacturing—Light), WM2 (Warehouse and Manufacturing—Heavy), WM4 (Airport Facilities), BCF3 (Business and Community Facilities—Large).
b. The city reserves the right to review, verify, and adjust the calculated Wastewater SCC based on an equivalent flow basis at any time.
c. Wastewater SCC shall be reviewed anytime a facility remodels, expands, or changes processes.
d. Facilities shall be charged the additional adjusted calculated Wastewater SCC amount in the year of adjustment.
e. Credits will not be granted for decreased capacity use or reductions in water meter size.
f. In no circumstances shall the calculated Wastewater SCC be less than the yearly charge as shown in the tables found in subsections 3 or 4.
(6) Collection of Wastewater System Capacity Charge (SCC).
Collection of the Wastewater SCC shall utilize the following process:
a) The Wastewater SCC is payable at the time of issuance and installation of a city water meter.
b) The city shall not issue the water meter or allow water connection until the Wastewater SCC and the material and cost of the meter has been paid in full.
(7) Exemptions.
The following are exempt from the Wastewater SCC or an increase in the Wastewater SCC:
a) A building or other structure for which a water meter application was filed prior to the effective date of this section or an amendment of this section, providing the information accompanying the application was complete to meet the requirements for issuance of a water meter for the entire structure, and all previously applicable fees and charges are paid, and substantial construction begins within 180 days of the date the water meter was issued.
b) Any structure that is built to replace a structure that was destroyed, demolished, or removed shall not be assessed Wastewater SCCs if construction of the new structure is completed within 60 months of the time that the original structure was destroyed, demolished, or removed, provided, however, that any new structure does not increase the size of the water meter.
c) Additions to single-family dwellings that do not constitute the addition of a dwelling unit, as defined by the city Uniform Building Code, are exempt from all portions of the Wastewater SCC, provided, however, that any new addition, renovation, or structure does not increase the size of the water meter.
d) An alteration, addition, replacement, or change in use that does not increase the parcel’s or structure’s size of the water meter.
e) Water meters used solely on fire suppression and irrigation systems.
f) Water meters that include service for fire suppression and irrigation systems will be charged the Wastewater SCC based on the approved implementation schedule and shall not be administratively calculated.
(8) Prohibited connection.
a) No person or entity may connect to the water or wastewater of the city unless the appropriate Wastewater SCC has been paid.
Section 2. That Section 51.082 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 51.082 FUNDS ESTABLISHED.
(a) There are hereby established the required accounts for the purpose of managing the revenues derived and to be derived from the city’s sanitary sewer system. A separate account, to be known as the operation and maintenance account, shall be established for purposes of paying the operation and maintenance costs of the POTW. Funds required for this account shall take precedence to ensure satisfactory operation of the system.
(b) A separate account to be known as the Regional SDC account shall be established and collected annually. The Regional SDC account funds will be allocated annually in accordance with the city’s internal policies. No regional wastewater customer or city wastewater customer shall have any right, title, or interest in such account.
(c) A separate account to be known as the Wastewater SCC account shall be established for the purpose of managing the revenues derived and to be derived from the city’s Wastewater SCC for the purposes of recovering past capital costs and fund the capital costs of developing new capacity, as defined in this chapter. The Wastewater SCC account funds will be allocated from time to time, in accordance with the city’s internal policies and pursuant to this chapter. No city water or wastewater customer shall have any right, title, or interest in such an account.

NOTICE OF AUDIT OF THE FISCAL AFFAIRS OF SIOUX FALLS SCHOOL DISTRICT NO. 49-5
NOTICE is hereby given that the records and books of account of Sioux Falls School District No. 49-5 of Minnehaha County, South Dakota, have been audited by Eide Bailly LLP for the fiscal year ended June 30, 2024, and that a detailed report thereon is filed with the governing board, the Director of Finance, and the Department of Legislative Audit, 427 South Chapelle, Pierre, South Dakota, for public inspection.
This notice is published in compliance with the provisions of SDCL 4-11-7.2.
Finding 2024-001 Audit Adjustments and Passed Audit Adjustments
Material Weakness
Criteria: The School District’s internal control structure should be designed to provide for the preparation of and recording and processing of all entries to the financial statements being audited in accordance with generally accepted accounting principles.
Condition: During our audit procedures, we identified certain misstatements as a result of our audit procedures brought to the attention of and corrected by management. We also identified certain misstatements, deemed to be immaterial individually and in the aggregate to the financial statements as a whole, that were passed on for adjustment by management. We, as the auditor, were requested to maintain the GASB 87 and 96 lease and SBITA schedules for the School District as a nonattest service and made the necessary adjustments as part of the audit for lease and SBITA activities under GASB 87 and 96, which are included as part of the corrected identified misstatements.
Cause: The School District’s internal controls did not identify and detect the misstatements noted during our audit, or in the case of GASB 87 and GASB 96 maintenance of schedules and calculation, the School District requested these to be performed by the auditor as a nonattest service and internal control would be to review and approve the result of the nonattest service provided. The School District, as a cost/benefit consideration, requested the maintenance of GASB 87 and GASB 96 schedules and calculations to be performed as a nonattest service with any proposed adjustments posted by the auditor.
Effect: The presence of identified audit adjustments and passed audit adjustments, or reliance on the auditor for certain adjustments, may affect the condition of financial information throughout the year being used by management in analysis and decision making and increase the risk that potential misstatements remain present in the financial statements.
Recommendation: We recommend management perform a thorough review of the account balances in each fund to ensure all necessary adjustments are reflected in the financial statements in accordance with generally accepted accounting principles. Furthermore, we recommend thorough review of all auditor-proposed adjustments from nonattest services provided prior to management approval.
Views of Responsible Officials: Management agrees with the finding. The School District, based upon consideration of certain cost and benefit factors of maintaining the lease and SBITA schedules internally and preparation of the related adjustments, determined requesting the auditor to maintain and prepare the schedules and proposed adjustments as the best use of current resources.

Period of Performance
Material Weakness in Internal Controls over Compliance and Material Non-Compliance
Criteria: In the CRRSSA and ARP Certification and Agreement, all institutions were given one calendar year from
the date of the Grant Award Notification to complete period of performance which was subsequently extended
to June 30, 2023. Department of Education provided guidance in Frequently Asked Questions #51 specific to
period of performance noting, “institutions now have 120 calendar days to liquidate all financial obligations
incurred under the award after the period of performance.” The 2024 compliance supplement also notes
specific to lost revenue, “For lost revenue, the obligation occurs on the date the institution completes its
estimate of its amount of lost revenue after the estimation period.”
Condition: Two errors were noted related to period of performance: 1) the lost revenue calculation was
completed in October 2023, which was after the June 30, 2023, period of performance date; and 2) the School
District also spent money on expenses for the program in November 2023 and January 2024, which was after
the 120-day liquidation period.
Cause: The School did not apply for a no cost extension to be able to obligate the funding after June 30, 2023.
For error #1, the School District was waiting to claim lost revenue until all expenses under the program were
incurred to be able to use any remaining funding available. For error #2, the School District believed that the
purchase orders that were outstanding after the 120-day liquidation period would be allowed to be paid when
items purchased were received.
Effect: The School received grant funding on allowable costs which were paid for or obligated after the period of
performance and liquidation period ended.
Questioned Costs: $539,358 specific to lost revenue and $179,409 for expenses paid for in November 2023 and
January 2024.
Context/Sampling: All lost revenue calculation reports were tested. We tested 40 out of 410 total expenses from
the program for other expenses. Total questioned costs for expenses was obtained from general ledger detail
for expenses paid after October 26, 2023.

Recommendation: We recommend a tracking schedule monitored by multiple people be maintained with all
required spending deadlines to ensure that funding is spent in the required timeframe. We also recommend
review of the grant agreements and grant funding information to ensure that knowledge of the requirements is
known by multiple people to ensure requirements are met.

Material Weakness in Internal Controls over Compliance and Material Non-Compliance
Criteria: The CARES Act, CRRSSA and the American Rescue Plan Act (ARP) sets forth the criteria for allowable
costs and activities.
Condition: During testing over the requirements, we noted that, in 28 of 40 expenses tested, reimbursement
was received for expenses for items that were never purchased. The total for these 28 items was $10,682.
Additional review noted a total of $132,071 for total funding received but not spent.
Cause: The School District used outstanding purchase obligations to request reimbursement at the end of the
liquidation period, but did not spend all of the money.
Effect: The School received reimbursement for items that were never purchased.
Questioned Costs: $132,071
Context/Sampling: A nonstatistical sample of 60 expenses submitted for reimbursement out of 410 total
expenses.

Recommendation: We recommend a review be completed to ensure that all reimbursements have proper
expenses to back up the request submitted. We also recommend that, if new funding is received, a committee
be set up by the School District to be able to review expenses and ensure that funding is spent on proper items
and requests for reimbursement are only made once expenses have been paid.

Criteria: For CRRSSA HEERF II and ARP HEERF III, the certification and agreements indicate the institutional aid
portion of funding should be disbursed within three calendar days from the drawdown from G5.
Condition: During testing over the requirement, it was noted that the amount drawn on October 25, 2023, was
not spent until November 2023, January 2024, or was never spent.
Cause: The School District was at the end of the 120-day liquidation period of performance so drew all remaining
available funding based on open purchase orders.
Effect: The School District received, but did not disburse, the funds within the allowed three-day timeframe.
Questioned Costs: $311,480
Context/Sampling: A nonstatistical sample of two draw requests out of five total draw requests were tested. Of
the $311,480 received, $179,409 was spent in November 2023 and April 2024 (also reported under period of
performance) and $132,071 was never spent (also reported under allowable costs).
Repeat Finding from Prior Year(s): No.
Recommendation: We recommend that reimbursement requests be submitted at the time of or after payments
for the expenses are made to ensure that timing of the reimbursement is received at the same time or after
payments are made.

Condition: There was no review of quarterly or annual HEERF reports prior to their submission.
Cause: Inadequate controls implemented to ensure compliance with HEERF reporting requirements.
Effect: Reports could be submitted with incorrect information.
Questioned Costs: None.
Context/Sampling: The one required quarterly report for the September 2023 quarter was tested and the annual
report for calendar year 2024 was tested.
Repeat Finding from Prior Year(s): Yes.
Recommendation: We recommend there is a separate, documented reviewer of the reports prior to their
submission.

Significant Deficiency in Internal Controls over Compliance and Noncompliance
Criteria: When Title IV funds are credited to a student account and they exceed the amount of tuition and fees,
food and housing, and other authorized charges assessed the student, a credit balance is created. The institution
must pay the resulting credit balance directly to the student or parent borrower within 14 days after (1) the first
day of class of a payment period if the credit balance occurred on or before that day, or (2) the balance occurred
if that was after the first day of class. Also, as allowed under 34 CFR 668.164(c)(3), a school may pay prior award
year charges up to $200. If over $200, student authorization is required to apply the payments to a prior-year
balance.
Condition: During testing over credit balances, 1) one student did not receive the refund on a timely basis; and
2) two students had amounts applied to a prior-year balance over $200.
Cause: The student was awarded aid at an off time in the semester, and the refund was not provided within the
14-day window. Also, turnover in staffing in the fall 2023 allowed disbursements to be applied to students prior year accounts receivable balances relating to tuition and fees or other charges.
Effect: The students were not given the refund in a timely manner or given the proper refund related to the
current award period.
Questioned Costs: None.
Context/Sampling: A nonstatistical sample of 61 students who received Title IV disbursements out of 1,491
students who received aid.
Repeat Finding from Prior Year(s): No.
Recommendation: We recommend disbursements made be reviewed to ensure that the refunds are being
provided to students on a timely basis. We also recommend controls be put into place to ensure that, if a
student has a balance over $200 from a prior award year, those accounts are reviewed to ensure that current year aid is not applied to prior-year balances.

Significant Deficiency in Internal Controls over Compliance and Non-Compliance
Criteria: 34 CFR section 685.309 sets forth the criteria for administrative and fiscal control and fund accounting
requirements for schools participating in the Direct Loan Program in regard to enrollment reporting
requirements.
Condition: The following instances were identified through our testing over enrollment reporting:
• 16 instances in which the student’s status change was certified outside the 60-day reporting
requirement.
Cause: For the students with certification dates outside of the required 60-day timeframe, information files were
not provided timely to the third-party provider to submit to NSLDS for reporting. The late reporting was specific
to the July 2023 and December 2023 graduation dates.
Effect: The errors in reporting resulted in reporting dates outside of the required reporting timeframe which
could impact the timing of required loan payments to be made.
Questioned Costs: None.
Context/Sampling: A nonstatistical sample of 60 students with a change in status out of approximately 693
students with a change in status were selected for testing of enrollment reporting requirements.
Repeat Finding from Prior Year(s): Yes.
Recommendation: We recommend the financial aid and registrar’s offices review controls over information
being entered into the software for dates and other academic information that is required to be reported to
ensure that status changes and other academic information are certified within 60 days of the effective date.
We also recommend that a monitoring system be put in place to track status changes and reporting of those
status changes that can be monitored by financial aid or the registrar’s offices.

SCHOOL BOARD MEETING
The School Board of the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, was called into regular session, pursuant to due notice, on Monday, March 24, 2025, at
5:30 pm in the Instructional Planning Center, 201 East 38th Street, Sioux Falls, South Dakota, with the following members present: Marc Murren, Gail Swenson, Nan Kelly, and Vice President Dawn Marie Johnson, and President, Carly Reiter. Absent: none. Dr. Jane Stavem, Superintendent of Schools, Todd Vik, Business Manager, and Brett Arenz, In-House Counsel, were also present.
DeeAnn Konrad, Community Relations Coordinator, discussed how extracurricular activities are an important part of the school experience, teaching students teamwork, determination, and that putting in the time is always worth it. Unified Games coach, Drake Bachmeier at Lincoln High School, added that Unified Games pair people with and without intellectual differences on the same team to encourage friendships, and leadership. The Unified Tournament will be on Friday, March 28th at 6:30pm at Lincoln High School.

Gay Anderson, Coordinator-Child Nutrition Services, presented the Nutrition Services report as follows (MRF#19583): The Sioux Falls School District’s Child Nutrition (CN) program plays a vital role in student success by providing nutritious meals that support learning. Through participation in multiple USDA-funded programs, including the National School Lunch Program, School Breakfast Program, and Child and Adult Care Food Program, students across all grade levels receive access to essential meals
Staffing for the program includes 144.75 full-time equivalent (FTE) positions, along with additional support personnel, who manage meal planning, purchasing, preparation, and service. Student participation guides menu decisions, balancing nutritional requirements with preferences to maximize engagement. Currently, over 48% of students qualify for free or reduced-price meals, and community support helps extend assistance to families just outside the federal eligibility thresholds.
Efforts to improve meal quality have led to the expansion of the hot meal preparation at elementary schools, ensuring fresher, higher-quality food. Financial sustainability remains a focus, with strategic food purchasing leading to cost savings despite rising prices. The CN program also carefully tracks USDA policy changes, as new regulations could impact meal benefits and funding.
To stay ahead of federal policy shifts, the Sioux Falls School District will participate in a national collaboration of nutrition leaders in Washington D.C. These efforts ensure the District remains informed, proactive, and prepared to advocate for policies that best serve students. A motion was made by Marc Murren and seconded by Gail Swenson five (5) votes “yes” on roll call acknowledging the Nutrition Services Report.
Action 39731
Todd Vik, Business Manager provided the 2025 Legislative Wrap-Up for review and approval. The Sioux Falls School District tracked 73 bills, of which eight were key bills. The District supported seven bills, of those six passed. The District was opposed to 41 bills, of which eight passed, including six key bills. Bill SB219 (passed), was opposed by the District and requires the acceptance of cash payment for admission to school-affiliated events with admission under $200. A key bill HB1039 (passed), was opposed by the District and repeals the programs reimbursing teacher/counselors for earning National Board Certification. Additionally, bill HB1040 (passed) was opposed by the District and reduces the state’s contribution from 2/3 to 1/2 of the high school dual credit program.

The School Board of the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, was called into special session, pursuant to due notice, on Wednesday, March 26, 2025, at 3:00 p.m. in the Instructional Planning Center, 201 East 38th Street, Sioux Falls, South Dakota, with the following members present: Gail Swenson, Marc Murren, Nan Kelly, Vice President Dawn Marie Johnson, and President Carly Reiter. Absent: none. Dr. Jane Stavem, Superintendent of Schools, Todd Vik, Business Manager, Dr. James Nold, Assistant Superintendent, Dr. Kirk Zeeck, Assistant Superintendent, Jeffer Kreiter, Director of Operational Services, and Becky Dorman, Senior Director of Human Resources, were also present.

NOTICE OF RESPONSIBILITY TO CONTROL NOXIOUS WEEDS AND DECLARED PESTS
NOTICE IS HEREBY GIVEN this 4th day of April, 2025 pursuant to SDCL 38-22 as amended to all owners, occupants, agents and public officials in charge of lands in Minnehaha County, South Dakota, that they are responsible for the suppression, control, and eradication of noxious weeds and declared pests’ infestations that may exist on such lands.
Chemical, biological, and / or cultural control methods used for the suppression, control and eradication of noxious weed and declared pest infestations shall be those approved for such purposes by the Minnehaha County Weed and Pest Supervisor, County Agricultural Extension Agent or the South Dakota State University Experiment Station.
Upon failure to observe this notice, the county weed and pest board is required to proceed pursuant to the law and have the noxious weeds or declared pests destroyed by such methods as they may find necessary, the expense of which shall constitute a lien and be entered as a tax against the land, and be collected as other real estate taxes are collected, or by other means as provided by law.
Plant and animals designated as being noxious weeds and declared pests in the state of South Dakota are Absinth Worm wood, Leafy Spurge, Salt Cedar, Perennial Sow Thistle, Hoary Cress, Canada Thistle, Purple Loosestrife, and Gypsy Moth.
Locally noxious weeds designated by the Minnehaha county Weed & Pest board and approved by the South Dakota Weed & Pest commission are Musk thistle, Plumeless thistle and Bull thistle.
NOTICE IS HEREBY GIVEN that upon establishing probable cause to believe a noxious weed or declared pest infestation exists upon any property in Minnehaha County, a representative of the Minnehaha County Weed and Pest Control board will enter upon said property for the purpose of inspecting and confirming that such infestation actually exists.

SPECIAL PERSONNEL ACTION
Upon the request of Carey Deaver, Human Resources Director, MOTION by Beninga, seconded by Bleyenberg, to Appoint Jacob Maras as Minnehaha County Highway Superintendent for the Highway Department Effective Immediately at a Salary of $5,080.00/biweekly (25/3). By roll call vote: 5 ayes.
PRESENTATIONS
Rebecca Knudsen, President & CEO of Lutheran Social Services, provided a brief presentation on Lutheran Social Services-Multi-Cultural Center. The presentation highlighted the work that is being done at the facility and the partnership between Lutheran Social Services, City of Sioux Falls, and Minnehaha County. The presentation went on to highlight priorities of the Multi-Cultural Center as well as programming. Valeria Wicker, Multi-Cultural Center, provided details on some of the groups that use the facility.
Mike Milstead, Sheriff, gave a briefing on the various divisions of the Minnehaha County Sheriff’s Office. The various divisions include patrol and jail. The patrol division highlighted the working relationship between agencies and departments, contracts with other organizations as well as the community events that the patrol division participates in. The presentation also highlighted that technology and equipment have continued to be areas with the most budget adjustments, as well as the large-scale antenna project with Motorola and the extensive training for the deputies. The presentation highlighted work completed at Southeast Technical College, South Dakota Air National Guard, and the Sioux Falls Airport. The past year was a fairly good year for the Minnehaha County Jail. The jail is continuing to recruit, hire and train new officers, with 2024 seeing 9 new hire classes that brought in 43 new officers with 38 of those officers remaining. In addition, there have been 3 new officers hired this year and the second new hire class started on March 31st with 4 additional new officers. The 2024 statistics related to the incidents at the jail as well as the average daily population and capacity were highlighted. The jail division also provided an update on the expansion to Unit Control 3 as well as preliminary 2026 budget considerations, including an increase in the medical contract to reflect wage increases, an increase in the food service contract, and the allocation of funds for the purchase of a jail transport vehicle to replace an existing vehicle.
EQUIPMENT PURCHASE
Upon the request of Mike McGovern, Lieutenant, MOTION by Beninga, seconded by Kippley, to Authorize the Jail to Purchase a Combi Oven for the Jail Kitchen through Sourcewell Contract #063022-COK for $40,019.45 installed. 5 ayes.
GRANT APPLICATION
Upon the request of Joe Bosman, Captain, MOTION by Bleyenberg, seconded by Heisey, to Authorize the Sheriff’s Office to Submit an Application for the 2026 South Dakota Highway Safety Grant. By roll call vote: 5 ayes.
AGREEMENT
Jamie Gravett, Juvenile Detention Center Director, presented a request for authorization for the Chair to sign an agreement with NCIC for correctional communications. This is the system our youth will use to communicate with their parents or guardians in the new facility. It is a tablet system which will also allow them to complete courses for self-improvement, listen to music, and read books. The jail uses this system, but our system will be a little different. In an effort to maintain low costs for families to stay in touch, the Juvenile Detention Center will not be receiving any commission. In the past, the Juvenile Detention Center had not charged fees for phone calls before and staff would like to continue this practice. The proposed agreement with NCIC was the best alternative. There is no cost to the County to have this available to families and the small fees paid by the families cover the cost. MOTION by Kippley, seconded by Bleyenberg, to Authorize the Chair to Sign an Agreement between JDC and NCIC for Correctional Communications. By roll call vote: 5 ayes.
RURAL ACCESS INFRASTRUCTURE
Jacob Maras, Highway Superintendent, presented a request for authorization for the Chair to sign a funding agreement between Minnehaha County and Edison Township for Rural Access Infrastructure Funding. The Rural Access Infrastructure Program was enacted during the 2021 South Dakota Legislative Session to assist with the replacement of large culverts and small bridges on township roads. The Minnehaha County Commission awarded Rural Access Infrastructure funding for 2025 at the January 7, 2025, Commission meeting. Edison Township applied for and awarded funding to one culvert for a project total of $50,794.00. Edison Township’s share is $10,158.00 with the remaining $40,636.00 provided by the County through the State-funded Rural Access Infrastructure Fund. MOTION by Beninga, seconded by Kippley, to Authorize the Chair to Sign a Funding Agreement between Minnehaha County and Edison Township for Rural Access Infrastructure Funding. The following projects were highlighted: Administration Security Office; Concrete Replacement; Courthouse Clerk of Courts Front Desk Expansion; Courthouse Fire Alarm System Replacement; Courthouse Law Library/Judges’ Office Renovations; Courthouse Museum Roof Repairs; Emergency Management Parking Lot; Existing Jail Refresh; Existing Jail Sealant Replacement; Extension Building Landscape Improvements; Fairgrounds Improvements; Furniture updates; Highway Facility Construction; Juvenile Justice Center; Parking Lot B/C Improvements; Parking Lot I Replacement; Public Defender Roof Top Unit Replacement; Security Upgrades; Sheriff’s Department Radio Equipment Structures; Signage/Wayfinding; and States Attorney Vault Renovation. Finally, Director Kriens highlighted the following additional projects that are undertaken by the department, which include asphalt patching, crack sealing, striping, and seal coating; Courthouse LED upgrades; Crooks Library gutters; flooring steam cleaning; HVAC upgrades; roof repairs/inspections; and tuckpointing/lintels/sealant.

NOTICE IS HEREBY GIVEN that, pursuant to SDCL §10-11-25, the Board of County Commissioners, sitting as a County Board of Equalization, of Lincoln County, South Dakota,
will begin meeting in the Commissioners’ Chambers in said County on Tuesday, the 8th day of April 2025, and for three weeks thereafter, for the purpose of reviewing, correcting, and equalizing the assessment of said County for the year 2025. The Board shall continue in session and may recess from time to time until all properly filed appeals have been determined and equalization is completed. The Board may remain in session no longer than three weeks after the second Tuesday in April.

Notice is hereby given that the records and books of account of Lincoln County, South
Dakota, have been audited by the Department of Legislative Audit for the year ended

The County incurred expenditures in excess of appropriations contrary to SDCL 7-21-25.
This is the third consecutive audit in which a similar finding was noted.
Recommendation:
We recommend that the County comply with SDCL 7-21-25.
Views of responsible officials:
To prevent funds from expending funds in excess of appropriations there will be
quarterly reviews of the accounts and supplemental hearings held when the department
head states that the purchase is outside of the budget. There has been additional
training to department heads to prevent future excess of appropriations.

COMMISSIONER DISCUSSION: Francene Hofer, County Treasurer, spoke to the Board about changes in the Treasurer’s Office. Due to the new 605 Drive Motor Vehicle System, the Treasurer’s Office has to be balanced by the end of the business day. In order for this to happen, they will stop processing title transfers and new title paperwork at 4:30. This change will take effect starting April 1st. No public input was heard.
COMMISSIONER BRIEFING: Drew DeGroot, Chief Civil Deputy State’s Attorney, presented information to the Board and asked for Board approval for a proposal for redesign of additional “shell” space to be built out to expand the States Attorney’s Office. Based on the information provided and re-design efforts, JLG developed the following scope of work for inclusion by amendment of the AIA Owner-Architect Agreement. Public input was heard.

In general, the project consists of improvements to the red wolf enclosure at the Great Plains Zoo. Work will include new viewing structure, sidewalk, exhibit barrier fencing, pedestrian fencing, electrical, final erosion control and landscaping.
The Issuing Office for the Bidding Documents is Stockwell Engineers located at 801 North Phillips Ave, Suite 100, Sioux Falls, SD 57104, (605) 338-6668. Prospective bidders may download and examine complete electronic bidding documents at no charge at the designated website, www.stockwellengineers.com.
Prospective Bidders are urged to register with the designated website as a plan holder, even if Bidding Documents are obtained from a plan room or source other than the designated website in either electronic or paper format. The designated website will be updated periodically with addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bidding Documents will be offered only through the designated website. A public hearing will be held by Microsoft Teams, on April 30, 2025, at 1:00 P.M. Central Time, to consider the adoption and amendment of proposed Administrative Rules of South Dakota numbered:

The effect of the rules will be to increase the cost of wiring permits from fifteen to twen-ty dollars, increase various inspection fees on electrical installations, repeal the following unique fee categories: outdoor signs and lighting, field irrigation systems, swimming pools, and carnivals, increase the cost of apartments from fifty to one hundred fifty dol-lars, and increase the administrative fee from one hundred to two hundred fifty dollars.
The reason for adopting the proposed rules is to increase revenue to sustain commission operations.
