Dispute over man's funeral arrangements lands in court
Daughter alleges funeral director shouldn't have allowed man's stepchildren to decide ceremony
A Lennox funeral director is denying that he failed to follow state law when he allowed the stepchildren of a man to determine his funeral arrangements.
In court papers filed this month, Jay Klusmann argues that he was following the provisions of a will stipulating that William Shumaker’s stepchildren would be responsible for planning his funeral.
Klusmann’s answer is in response to a lawsuit filed by Tamera Haase, a Shorewood, Minnesota woman and biological daughter of Shumaker’s. Haase filed suit against Klusmann and the Dindot-Klusmann Funeral Home in Lennox, arguing that Klusmann failed to follow state law that prioritizes the disposition of a decedent’s remains.
“Because she was unable to properly mourn and say goodbye to her father, Haase has suffered mental and physical anguish including, but not limited to, loss of sleep, anxiety, depression, persistent respiratory congestion, public embarrassment, loss of appetite, anger, night terrors, and grief,” her lawsuit alleges.
