Deuel County, contractor in dispute over multi-million dollar contract
Minnesota company blames county for extra roadwork it had to perform
Deuel County is locked in a court battle with a Minnesota road construction company over the mishaps that occurred during a road repair project that commenced last year.
What started as a $4.6 million project that Duininck won as low bidder ended up costing the company money because the initial bid documents were flawed, requiring the company to perform work that was not anticipated. That work, the company contends, was not its responsibility, beyond its control and “outside its knowledge at the time of the project bid,” the company says in a federal lawsuit filed against Deuel County.
“Deuel County’s plans and specifications for the Project were riddled with errors and omissions that rendered them unworkable and/or unconstructible,” the company’s lawsuit says.
