Beresford parents accuse school district of discriminating against son who had behavior problems
Disabilities forced student to act out and district removed boy from classes
The parents of a Beresford School District student are accusing the district and its employees of failing to follow federal law in establishing a specialized behavior plan for their son.
In a lawsuit brought in federal court, Sherry and Stephen Vandre allege the district violated the Americans with Disabilities Act, the Rehabilitation Act of 1973 and the constitutions of the United States and South Dakota.
The Vandres argue their son, who is now 13 and identified by his initials as SRV, qualified to receive an Individual Education Plan because he has disabilities. Those disabilities include anxiety, ADHD, Oppositional Defiant Disorder and a depressive disorder.
“SRV’s disability limits major aspects of his life, making many everyday activities difficult for him, especially the ability to focus, properly interact with those around him and control his aggression and behaviors,” the lawsuit says.
