AG: No conflict in state's attorney's staffer serving on Rapid City school board

An employee in a Black Hills county prosecutor's office is eligible to serve on the local school board.
That’s according to South Dakota Attorney General Marty Jackley, who has issued a three-page opinion deeming Rapid City Area Schools (RCAS) Board of Education candidate Kathy Urban eligible to hold public office. Urban is employed with the Pennington County State’s Attorney’s Office.
“I conclude that the position of Public Information Officer in the Pennington County State's Attorney's Office is compatible with the duties of a Rapid City Area School Board member and does not present a per se conflict of interest,” Jackley wrote, citing an analysis of facts using a 1972 criteria established under Attorney General Gordon Mydland to determine if two public offices are compatible if held by the same person at the same time.
